Translation · EN

His inheritance is not voided under any circumstances. The mother does not take [from his wealth] because she does not have legal authority (wilayah). The grandfather also does not have wilayah over the wealth of his son's child, and his compassion is lesser than that of the father; he is blocked by the father in inheritance and in the wilayah of marriage. Others among the relatives and strangers have no right to take [wealth] by way of analogy (tanbih), because if taking is prohibited in the case of the mother and the grandfather, despite their sharing with the father in some aspects, then others who do not share with the father in that regard are more deserving of prohibition.

936 - Issue: He said: "It is not lawful for a donor to retract his gift, nor for a giver of a present to retract his present, even if he has not been compensated for it."

Meaning, even if he has not been given something in return for it. He intended those other than the father, because he has already stated that the father may retract [a gift] according to his saying: "He is commanded to return it." As for anyone else, he has no right to retract his gift or his present. This is the opinion of al-Shafi'i and Abu Thawr. Al-Nakha'i, al-Thawri, Ishaq, and the People of Opinion (Ashab al-Ra'y) said: Whoever gives a gift to someone who is not a relative, he may retract it as long as he is not compensated for it, and whoever gives a gift to a relative, he may not retract it. This has been narrated from Umar ibn al-Khattab, may Allah be pleased with him. They argued based on what Abu Hurayrah narrated, saying: The Messenger of Allah (peace and blessings of Allah be upon him) said: "A man has more right to his gift as long as he has not been compensated for it." It was narrated by Ibn Majah in his "Sunan". [They also argued] by the statement of Umar, and because he did not obtain a compensation for it, so he is permitted to retract it, like a loan (ariyah). Our evidence is the statement of the Prophet (peace and blessings of Allah be upon him): "The one who returns to his gift is like the one who returns to his vomit." In one wording: "Like the dog returning to its vomit." And in one narration: "We do not have a base example; the one who returns to his gift is like the dog returning to its vomit."
