Translation · EN

And if one of them measured it and an outsider carried it by his order, it is as if the one who measured it carried it. If it was by the order of the other, it is as if the other carried it. If he carried it without the order of either of them, it is as if he had measured it and then carried it.

905 - Issue; He said: "And it is not permissible to hire for the duration of his military expedition."

This is the opinion of the majority of scholars, including al-Awza'i, al-Shafi'i, and the People of Reason (Ashab al-Ra'y). Malik said: "The aspect of that is known, and I hope it is valid." As for us, this is a lease for an unknown duration and an unknown labor, so it is not permissible, just as if he had hired it for the duration of his travel for trade. Because the duration of a military expedition is long and short, and it has no limit by which it is known; the work therein is little and much, and the end of their travel is near and far. Thus, estimation by it is not permissible, like other unknown travels. If he does that, he is entitled to the fair wage (ajr al-mithl) because he contracted for compensation that was not delivered to him due to the invalidity of the contract, so the fair wage became due, like all other invalid leases.

906 - Issue; He said: "If he names a known amount for each day, it is permissible."

Its summary is that whoever hires a horse for the duration of his military expedition, for one dirham each day, the text narrated from Ahmad indicates its validity. Al-Shafi'i said: This is invalid because the duration of the lease is unknown. As for us, 'Ali, may Allah be pleased with him, hired himself out for every bucket for a date, and likewise the Ansari, and the Prophet (peace and blessings of Allah be upon him) did not disapprove of it. Furthermore, every day has a known duration and wage, so it is valid, just as if he said: "I have leased it to you for a month, for one dirham each day." Or he said: "I have hired you to transport this heap (subra), for one dirham per qafiz." It is necessary to specify what he is hiring it for, either for riding or for a known load. He is entitled to the named wage for each day, whether it is stationary or traveling, because the benefits passed during its duration, so it resembles...

وإن كَالَه أحَدُهُما وحَمَلَه أجْنَبِىٌّ بأَمْرِه، فهو كما لو حَمَلَه الذي كَالَهُ، وإن كان بأمْرِ الآخَرِ، فهو كما لو حَمَلَهُ الآخَرُ، وإن حَمَلَهُ بغيرِ أمْرِهِما، فهو كما لو كَالَه ثم حَمَلَهُ.

٩٠٥ - مسألة؛ قال: (وَلَا يَجُوزُ أنْ يَكْتَرِىَ مُدَّةَ (١) غَزَاتِهِ)

هذا قولُ أكْثَر أهْلِ العِلْمِ، منهم الأوْزاعِىُّ، والشافِعِىُّ، وأصْحابُ الرَّأْى. وقال مالِكٌ: قد عُرِفَ وَجْهُ ذلك، وأرْجُو أن يكونَ حَقِيقًا. ولَنا، أنَّ هذه إجَارَةٌ، في مُدَّةٍ مَجْهُولةٍ، وعَمَلٍ مَجْهُولٍ، فلم يَجُزْ، كما لو اكْتَرَاها (٢) لِمُدَّةِ سَفَرِه في تِجَارَتِه، ولأنَّ مُدَّةَ الغَزَاةِ تَطُولُ وتَقْصُرُ، ولا حَدَّ لها تُعْرَفُ به، والعَمَلُ فيها يَقِلُّ ويَكْثُرُ، ونِهايةُ سَفَرِهِم تَقْرُبُ وتَبْعُدُ، فلم يَجُز التَّقْدِيرُ بها، كغَيْرِها من الأسْفارِ المَجْهُولةِ. فإن فَعَلَ ذلك، فله أجْرُ المِثْلِ؛ لأنَّه عَقَدَ على عِوَضٍ لم يُسَلَّمْ له، لِفَسَادِ العَقْدِ، فوَجَبَ أجْرُ المِثْلِ، كسائِر الإِجَاراتِ الفاسِدَةِ.

٩٠٦ - مسألة؛ قال: (فَإنْ سَمَّى لِكُلِّ يَوْمٍ شَيْئًا مَعْلُومًا، فَجَائِزٌ)

وجملتُه أنَّ مَن اكْترَى فَرَسًا مُدَّةَ غَزْوِه، كلَّ يوم بِدِرْهمٍ، فالمَنْصُوصُ عن أحمدَ صِحَّتُه. وقال الشافِعِىُّ: هذا فاسِدٌ؛ لأنَّ مُدَّةَ الإِجارَةِ مَجْهُولةٌ. ولَنا، أنَّ عَلِيًّا، رَضِىَ اللَّه عنه، أجَرَ نَفْسَه كلَّ دَلْوٍ بِتَمْرَةٍ (١)، وكذلك الأنْصارِىُّ (٢)، ولم يُنْكِرْه النبيُّ -صلى اللَّه عليه وسلم-، ولأنَّ كلَّ يومٍ مَعْلُومٌ مُدَّتُه وأُجْرَتُه، فصَحَّ، كما لو قال: أجَرْتُكَها شَهْرًا، كلَّ يومٍ بدِرْهَمٍ. أو قال: اسْتَأْجَرْتُكَ لِنَقْلِ هذه الصُّبْرةِ، كلَّ قَفِيزٍ بدِرْهَمٍ. ولا بُدَّ من تَعْيِينِ ما يَسْتَأْجِرُ له، إمَّا لِرُكُوبٍ، أو حَمْلٍ مَعْلُومٍ. ويَسْتَحِقُّ الأجْرَ المُسَمَّى لكلِّ يومٍ، سواءٌ كانت مُقِيمَةً أو سائِرَةً؛ لأنَّ المنافِعَ ذَهَبَتْ في مُدَّتِه (٣)، فأشْبَهَ
