Iraq. The Qadi said: The wealth is for the paternal aunt of the father, because she is more antecedent, as she is the sister of the grandfather, who is an heir. This is the position of most of the replacement practitioners, because they grant inheritance to the most antecedent in every case. A maternal aunt of a mother and a paternal aunt of a father: the maternal aunt has the one-sixth, and the remainder is for the paternal aunt, because they are like a grandfather (6) and a grandmother. The same position holds for a maternal aunt of a father and his paternal aunt. A maternal aunt of a mother and a maternal aunt of a mother of a father: the wealth is for the maternal aunt, because they are in the position of the mother of the mother and the mother of the mother of the father. A maternal uncle of a father and a paternal uncle of a mother: the wealth is for the maternal uncle, because he is in the position of a grandmother, and grandmothers are in the position of mothers. A daughter of a maternal uncle of a mother and a daughter of a paternal uncle of a father: the daughter of the maternal uncle has the one-sixth, and for the daughter of the paternal uncle is what remains. Whoever grants inheritance to the most antecedent makes the entirety for the daughter of the paternal uncle. The father of the father of the mother and the father of the mother of the father: the wealth is for the father of the mother of the father. If there is with them the father of the mother of the mother, it is between them in halves, because they are in the position of two parallel grandmothers. The father of the mother of the father of (7) the mother and the father of the father of the mother of the mother: the wealth is for the latter, because he is more antecedent. If there is with them the father of the mother of the father of the father, the wealth is for him, because he meets the heir at the first degree. [A father and a mother] (8) of the father of the mother: for the mother of the father of the mother is the one-third, and the remainder is for the father. If there is with them the father of the mother of the mother, the wealth is for him, because he is related through an heir. And if there is with them the father of the mother of the father, the wealth is between this one and the preceding one in halves.

Section: When a person of the womb (dhu al-rahim) has two kinship relations, he inherits by both, by the consensus of those who assign inheritance to them, except for something narrated from Abu Yusuf that they do not inherit except by one kinship. That is not authentic from him, nor is it correct in itself, because he is a person who has two categories that do not outweigh one another, so he inherits by both, like a spouse if he is a paternal cousin, and the paternal cousin if he is a maternal brother. The calculation of that is to treat the one with two kinships as two persons (9), so you say regarding a son of a daughter of a daughter, he is a son of a daughter of another daughter, and a daughter of a daughter of another daughter: for the son is two-thirds, and for the daughter is one-third. If their mother is one, he has three-fourths of the wealth.
