and between it and it on seven, he has six, and she has one share, and all of them are coprime, so multiply four by seven by nine by the base of the problem, which becomes seven hundred and fifty-six; for the one acknowledged as both, six times four times seven is one hundred and sixty-eight; for the acknowledger of the sister, six times four times nine is two hundred and sixteen; for the acknowledger of the brother, three times seven times nine is one hundred and eighty-nine; for the brother acknowledged, two shares times four times seven is fifty-six, and one share times seven times nine is sixty-three, so they aggregate for him to one hundred and nineteen; and for the sister, one share times four times seven is twenty-eight, and one share times four times nine is thirty-six, they aggregate for her to sixty-four. There is no difference whether they confirm or deny each other because there is no excess in the hand of either of them over his inheritance. If there were a fourth son in this problem who did not confirm him regarding either one of them, the base of the problem would be from four shares: one on eleven, one share on nine, one share on five, and one share that the denier keeps to himself, so the problem is valid from one thousand nine hundred and eighty shares, and the method of calculation for it is like the one before it.

Section: If he leaves a daughter and a sister, and they acknowledge a young girl, the daughter said: She is a sister. The sister said: She is a daughter. Then she gets one-third of what is in the hand of the sister, and nothing else. This is the statement of Ibn Abi Layla, and regarding Muhammad ibn al-Hasan, al-Lu'lu'i, and Yahya ibn Adam, there is much confusion, the mention of which would be lengthy. If he leaves a wife, a daughter, and a sister, and they acknowledge a young girl, and the wife said: She is a wife. The daughter said: She is a daughter. And the sister said: She is a sister. Al-Khabri said: She is given one-third of the estate; because it is the most possible that could be for her, and it is taken from the acknowledgers according to their acknowledgments. The daughter has acknowledged for her four shares out of twenty-four, the sister acknowledged for her four and a half, and the wife acknowledged for her one and a half,

وبينها (٢١) على سَبْعةٍ (٢٢)، له سِتَّةٌ (٢٣)، ولها سَهْمٌ، وكلُّها متباينة، فاضرِبْ أرْبعةً فى سبعةٍ، فى تِسْعَةٍ، فى أصْلِ المسْألَةِ، تكنْ سَبْعَمائة وسِتَّة وخَمْسينَ، للمُقِرِّ بهما سِتّةٌ، فى أربعةٍ، فى سَبْعةٍ، مائةٌ وثمانيةٌ وستون، وللمُقِرِّ بالأخْتِ سِتّةٌ، فى أرْبعةٍ، فى تِسْعةٍ، مائتان وسِتَّةَ عَشَرَ، وللمُقِرِّ بالأخِ ثلاثة، فى سَبْعةٍ، فى تِسْعةٍ، مائةٌ وتِسْعةٌ وثمانون، وللأخِ المُقَرِّ به سهمانِ، فى أرْبعةٍ، فى سَبْعةٍ، سِتةٌ وخمسون، وسهمٌ فى سبعةٍ (٢٢)، فى تِسْعةٍ، ثلاثةٌ وسِتّون، فيجْتَمعُ له مائةٌ وتِسْعَةَ عَشَرَ، وللأخْتِ سهمٌ، فى أرْبعةٍ، فى سَبْعةٍ، ثمانيةٌ وعشرون، وسهمٌ فى أرْبعةٍ، فى تِسْعةٍ، ستَّةٌ وثلاثون، يَجْتَمِعُ لها أرْبعةٌ وسِتّون، ولا فَرْقَ بينَ تصَادُقِهما، وتجاحُدِهما؛ لأنَّه لا فضْلَ فى يدِ أحدِهما عن ميراثهِ. ولو كان فى هذه المسْألةِ ابنٌ رابعٌ، لم يُصدِّقْه فى واحدٍ منهما، كان أصْلُ المسْألةِ من أربعةِ (٢٤) أسْهُمٍ، على أحَدَ عَشَرَ، وسَهْمٍ على تِسْعةٍ، وسَهْمٍ على خَمْسةٍ، وسَهْمٍ يَنْفرِدُ به الجاحِدُ، فتصِحُّ المسألةُ منْ ألفٍ وتِسْعِمائةٍ وثمانين سهمًا، وطريقُ العَمَلِ فيها كالتى قَبْلَها.

فصل: إذا خلَّفَ بنْتًا وأخْتًا، فأقرَّتا لصغيرةٍ، فقالتِ البِنْتُ: هى أُخْتٌ. وقالتِ الأخْتُ: هى بنتٌ. فلها ثلُثُ ما فى يدِ الأخْتِ لا غيرُ. وهذا قولُ ابنِ أبى لَيْلى، ولمحمّدِ بنِ الحسَنِ، واللُّوْلُؤىِّ، ويحيى بن آدمَ، تخْبِيطٌ كثيرٌ، يطُولُ ذِكْرُه. وإِنْ خَلَّفَ امرأةً وبنتًا وأخْتًا، فأقْرَرْنَ بصغيرةٍ، فقالتِ المرأة: هى امرأةٌ. وقالتِ البنتُ: هى بنتٌ. وقال الأختُ: هى أُخْتٌ. فقال الْخَبْرِىُّ: تُعْطَى ثُلُثَ المالِ؛ لأنَّه أكثرُ ما يُمْكِنُ أنْ يكونَ لها، ويُؤْخَذُ من المُقِرَّاتِ على حَسَبِ إقْرارِهنَّ، وقد أقرّتْ لها البنْتُ بأربعةِ أسْهمٍ من أربعةٍ وعشرين، وأقرّتْ لها الأختُ بأرْبعةٍ ونِصْفٍ، وأقرّتِ المرأةُ بسهْمٍ ونصفٍ،
