Translation · EN

the child is not liable. If the slave destroys it, it is a liability on his personal responsibility (dhimma). If we say: He is liable, it is attached to his person (raqaba).

Section: If the deposit is forcibly usurped from the depository, there is no liability upon him, whether it was taken from his hand, or he was coerced into delivering it and delivered it himself; because coercion is an excuse for him, which permits him to yield it, so he is not liable for it, just as if it were taken from his hand by force.

يَضْمَنُ الصَّبِىُّ. فأتْلَفَها العَبْدُ، كانت فى ذِمَّتِه. وإن قُلْنا: يَضْمَنُ. كانت فى رَقَبتِه.

فصل: وإن غُصِبَتِ الوَدِيعةُ من المُودَعِ قَهْرًا، فلا ضَمانَ عليه، سواءٌ أُخِذَتْ من يَدِه، أو أُكْرِه على تَسْلِيمِها فسَلَّمها بنَفْسِه؛ لأنَّ الإِكْراهَ عُذْرٌ له (١٢)، يُبِيحُ (١٣) دَفْعَها، فلم يَضْمَنْها، كما لو أُخِذَتْ من يَدِه قَهْرًا.
