nor is there any inheritance for her from either of them, nor does either of them inherit from her. Thus [it is]. If that is not known and their marriage is annulled, it is narrated from Ahmad that she is entitled to half of the dowry, and they draw lots for it; because one of their contracts is valid, and his marriage was annulled before consummation, so he is obligated for half of her dowry, just as if he had performed khul' (divorce initiated by the wife) with her. Abu Bakr said: There is no dowry for her; because they are compelled to divorce, so no dowry is binding upon them, just as if the judge annulled the marriage of a man due to his insolvency or his impotence. If she dies before the annulment and the divorce, one of them is entitled to half of her inheritance, so the matter is suspended until they settle upon it. It is possible that lots are drawn between them, and whoever the lot falls to, he swears that he is the rightful one and inherits. If both husbands die, she has a quarter of one of their inheritances. If she had confessed that one of them was the predecessor in the contract, she has no inheritance from the other, and she claims a quarter of the inheritance of the one for whom she confessed. If he had also claimed that, he pays her a quarter of his inheritance; and if he had not claimed that, and the heirs deny it, then their statement is accepted along with their oaths, and if they refuse to swear, judgment is passed against them. If the woman had not confessed to the precedence of one of them, it is possible that the heirs of each of them take an oath and are absolved, and it is possible that lots are drawn between them, and whoever the lot falls to, she has a quarter of his inheritance. Hanbal has narrated from Ahmad regarding a man who had three daughters; he married one of them to a man, then the father died and it was not known which one he had married: they draw lots among them, and whichever one the lot falls to is his wife, and if the husband dies, she is the one who inherits from him. And Allah knows best.

مِيراثَ لها منهما، ولا يَرِثُها واحدٌ منهما؛ لذلك (١٣) وإن لم يُعْلَمْ ذلك ففُسِخَ (١٤) نِكاحُهُما، فرُوِىَ عن أحمدَ أنَّه يَجِبُ لها نِصْفُ المهْرِ، ويَقْتَرِعانِ عليه؛ لأنَّ عَقْدَ أحَدِهِما صَحِيحٌ، وقد انْفَسَخَ نِكاحُه قبلَ الدُّخولِ، فوَجَبَ عليه نِصْفُ مَهْرِها، كما لو خَالَعَها. وقال أبو بكرٍ: لا مَهْرَ لها؛ لأنهما مُجْبَرانِ على الطَّلاقِ، فلم يَلْزَمْهُما مَهْرٌ، كما لو فَسَخَ الحاكمُ نِكاحَ رَجُلٍ لِعُسْرِه (١٥) أو عُنَّتِه (١٦). وإن ماتت قبلَ الفَسْخِ والطَّلاقِ، فلأحَدِهما نِصْفُ مِيراثِها، فيُوقَفُ الأمْرُ حتى يَصْطَلِحَا عليه. ويَحْتَمِلُ أن يُقْرَعَ بينهما، فمن خَرَجَتْ له القُرْعةُ، حَلَفَ أنَّه المُسْتَحِقُّ ووَرِثَ. وإن مات الزَّوْجانِ، فلها رُبْعُ مِيراثِ أحَدِهما. فإن كانتْ قد أقَرَّتْ أَنَّ أحَدَهُما سابقٌ بالعَقْدِ، فلا مِيراثَ لها من الآخَرِ، وهى تَدَّعِى رُبْعَ مِيراثِ مَنْ أقَرَّتْ له. فإن كان قد ادَّعَى ذلك (١٧) أيضًا، دَفَعَ إليها رُبْعَ مِيراثِه، وإن لم يكُنِ ادَّعَى ذلك، وأَنْكَرَ الوَرَثةُ، فالقولُ قولُهم مع أيْمانِهِم، فإن نَكَلُوا قُضِىَ عليهم. وإن لم تكُنِ المرأةُ أقَرَّتْ بسَبْقِ أحَدِهما، احْتَمَلَ أن يَحْلِفَ وَرَثةُ كلِّ واحدٍ منهما ويَبْرأ، واحْتَمَلَ أن يُقْرَعَ بينهما، فمَن خَرَجَتْ قُرْعَتُه فلها رُبْعُ مِيراثِه. وقد رَوَى حَنْبَلٌ عن (١٨) أحمدَ، فى رَجُلٍ له ثلاثُ بناتٍ، زَوَّجَ إحْداهُنَّ من رَجُلٍ، ثم مات الأبُ، ولم يُعْلَمْ أيَّتُهُنَّ (١٩) زَوَّجَ: يُقرَعُ بينهنَّ، فأيَّتُهُنَّ أصَابَتْها القُرْعةُ فهى زَوْجَتُه، وإن مات الزَّوْجُ فهى التى تَرِثُه. واللَّه أعلم.

فصل: وإن ادَّعَى كلُّ واحدٍ منهما أنَّه السَّابقُ، فأقَرَّتْ لأحَدِهما، ثم فُرِّقَ بينهما،
