sermon. A bondswoman belonging to Ibn Umar was proposed to, and he did no more than say: "We have married you based on what Allah has commanded, either by retention in kindness or release with beneficence (52)." Ja'far ibn Muhammad reported from his father that Al-Husayn would marry off some of the daughters of Al-Hasan while he was gnawing on a piece of meat (53). Both were narrated by Ibn al-Mundhir. Abu Dawud (54) narrated with his chain of authority from a man of the Banu Sulaym who said: "I proposed to the Messenger of Allah (may the peace and blessings of Allah be upon him) for Umamah bint Abd al-Muttalib, and he married her to me without delivering a sermon." Furthermore, because it is a commutative contract, a sermon is not obligatory in it, just as it is not in a sale. What they used as evidence only indicates that the matter is not perfect without the sermon, not that it is obligatory.
Section: It is recommended to announce the marriage and to beat the duff (hand drum) during it. Ahmad said: "It is recommended that the marriage be made public and the duff beaten during it, so that it becomes known and publicized." It was said to him: "What is the duff?" He replied: "This duff." He said: "There is no harm in reciting poetry at a wedding, such as what the Prophet (may the peace and blessings of Allah be upon him) said to the Ansar: 'We have come to you, we have come to you, so greet us and we shall greet you. Were it not for the red gold, your valley would not have been settled, and were it not for the black seed (55), your maidens would not have been happy' (56)." This is not like what people do today. خطْبَةً. وخُطِبَ إلى ابنِ (٥٠) عمرَ مَوْلاةٌ له، فما زادَ على أن قال: قد (٥١) أنْكَحْناكَ على ما أمَرَ اللَّه، على إمْساكٍ بمَعْرُوفٍ، أو تَسْرِيحٍ بإحْسانٍ (٥٢). وقال جَعْفرُ بن محمدٍ، عن أبِيه، إن كان الحُسَيْنُ لِيُزَوِّجَ بعضَ بَناتِ الحَسَنِ، وهو يتَعَرَّقُ العَرْقَ (٥٣). رَوَاهُما ابنُ المنذرِ. ورَوَى أبو داودَ (٥٤)، بإسْنادِه عن رَجُلٍ من بنى سُلَيْمٍ، قال: خَطَبْتُ إلى رسولِ اللَّه -صلى اللَّه عليه وسلم- أُمامةَ بنتَ عبدِ المُطَّلِبِ، فأنْكَحَنَى من غيرِ أن يتَشَهَّدَ. ولأنَّه عَقْدُ مُعَاوَضةٍ، فلم تَجِبْ فيه الخُطْبةُ كالبَيْعِ، وما اسْتَدَلُّوا به يَدُلُّ على عَدَم الكَمالِ بدونِ الخُطْبةِ، لا على الوُجُوبِ.
فصل: ويُسْتَحَبُّ إعْلانُ النِّكاحِ، والضَّرْبُ فيه بالدُّفِّ. قال أحمدُ: يُسْتَحَبُّ أن يُظْهَرَ النِّكاحُ، ويُضْرَبَ فيه بالدُّفِّ، حتى يَشْتَهِرَ ويُعْرَفَ. وقيل له: ما الدُّفُّ؟ قال: هذا الدُّفُّ. قال: لا بأسَ بالغَزَلِ فى العُرْسِ بمثلِ قولِ النَّبِىِّ -صلى اللَّه عليه وسلم- للأنصارِ: "أتَيْنَاكُم أتَيْنَاكُم، فحَيُّونَا نُحَيِّيكُم، لَوْلا الذَّهَبُ الأحْمَرُ ما حُلَّتْ بوَادِيكُم، ولَوْلَا الْحَبَّةُ (٥٥) السَّوداءُ ما سُرَّتْ عَذارِيكُم" (٥٦). لا على ما يَصْنَعُ الناسُ اليومَ. ومن غيرِ هذا الوَجْهِ:
