The opinion of Zayd and those who agree with him is that the mother has a third; its origin is from three, and two shares remain between the sister and the grandfather, divided by three, and it is valid from nine. According to the opinion of Ali, the sister has half, the mother has a third, and the grandfather has the sixth. From Umar and Abdullah, the sister has half, the mother has a third of the remainder, and what remains is for the grandfather. From Ibn Mas'ud: the mother has the sixth, and the remainder is for the grandfather; this is the same as the first opinion in meaning. Also from Ibn Mas'ud, the sister has half, and the remainder is divided between the grandfather and the mother into two halves, so it is from four; this is one of the four-way divisions (murabba'at) of Ibn Mas'ud. Uthman said: The estate is in thirds among them, each of them having a third. This is the tripartition (muthallathah) of Uthman. It is called the seven-fold (musabba'ah), as there are seven opinions regarding it. It is also called the six-fold (musaddasah) because the meanings of these opinions reduce to six. Al-Hajjaj asked al-Sha'bi about it, and he replied: Five of the Companions of the Messenger of Allah, peace and blessings of Allah be upon him, differed concerning it. He mentioned Uthman, Ali, Ibn Mas'ud, Zayd, and Ibn Abbas to him.

Section: A mother or a grandmother, two sisters, and a grandfather; the division (muqasama) is better for the grandfather, and five remain for four, so it is valid from twenty-four. A mother, a brother, and a sister, or three sisters and a grandfather, it is valid from six. A mother, two brothers, or a brother and two sisters, or four sisters and a grandfather; a third of the remainder and the division are equal. If they exceed this, a third of the remainder is fixed for the grandfather, and the issue shifts to eighteen; the mother has three, the grandfather has five, and ten remain for the brothers and sisters, so the issue is corrected (tusahhah) for them. If the brothers and sisters are from both sides (full-siblings), then the entire remainder is for the child of both parents, unless the child of both parents is a single sister, in which case she has the amount of her fixed share, and the remainder is for them. A mother, a sister from both parents, a brother and a sister from a father, and a grandfather; the mother has the sixth, and the grandfather has a third of the remainder, shifting to eighteen; the mother has three, the grandfather has five, and the sister from both parents has the half, which is nine; one share remains for three, so it is valid from fifty-four. This is called the 'Shortened [Issue] of Zayd' (mukhtasarat Zayd), because if he had performed the division with the grandfather, it would have shifted to thirty-six.

والباقى للجَدِّ. وقولُ زَيْدٍ وموافِقِيه، للأُمِّ الثُّلُثُ، أصْلُها من ثلاثةٍ، ويَبْقَى سَهْمانِ بين الأختِ والْجَدِّ، على ثلاثةٍ، وتصحُّ من تِسْعَةٍ. وقولُ عليٍّ، للأُختِ النِّصفُ، وللأُمِّ الثُّلُثُ، وللجَدِّ السُّدُسُ. وعن عمرَ وعبدِ اللهِ، للأُخْتِ النِّصْفُ، وللأُمِّ ثُلُثُ ما بَقِىَ، وما بَقِىَ فللجَدِّ. وعنِ ابنِ مَسْعُودٍ: للأُمِّ السُّدُسُ، والباقِى للجَّدِّ، وهو (١) مثلُ القَوْلِ الأوَّلِ في المَعْنَى. وعن ابنِ مَسْعُودٍ أيضًا، للأختِ النِّصْفُ، والباقِى بين الجدِّ والأمِّ نِصْفان، فتكونُ مِن أربعةٍ، وهى إحْدَى مُرَبَّعاتِ ابنِ مَسْعُودٍ. وقال عثمانُ: المالُ بينهم أثلاثٌ، لكلِّ واحدٍ منهم ثُلُثٌ. وهى مُثَلَّثَةُ عثمانَ. وتُسَمَّى المُسَبَّعَةَ، فيها سَبْعةُ أقوالٍ. والمُسَدَّسةُ؛ لأنَّ معنى الأقوالِ يَرْجِعُ إلى سِتَّةٍ. وسأل الحجَّاجُ عنها الشَّعْبِىَّ، فقال: اخْتَلَفَ فيها خمسةٌ من أصحابِ رسولِ اللهِ -صلى اللَّه عليه وسلم-. وذكَرَ له عُثمانَ وعليًّا وابْنَ مَسْعُودٍ وزيدًا وابنَ عبَّاسٍ.

فصل: أمٌّ أو جَدَّةٌ وأختانِ وجَدٌّ، المُقاسمةُ خيرٌ للجَدِّ، ويَبْقَى خَمْسَةٌ على أَرْبَعةٍ، فتَصِحُّ من أربعةٍ وعِشْرينَ. أمٌّ وأخٌ وأختٌ، أو ثلاثُ أخواتٍ وَجَدٌّ، تَصِحُّ مِنْ سِتَّةٍ. أمٌّ وأخَوَانِ، أو أخٌ وأختانِ، أو أربعُ أخواتٍ وَجَدٌّ؛ ثُلُثُ الباقِى والمُقاسَمَةُ سواءٌ، فإنْ زَادُوا عَلَى ذَلِك فُرِضَ للجَدِّ ثُلُثُ الباقِى، وانْتَقلتِ المسألة إلى ثَمانِيةَ عَشَرَ؛ للأُمِّ ثلاثةٌ، وللجَدِّ خَمْسَةٌ، يبقَى عَشْرَةٌ للإِخْوةِ والأخَواتِ، فتُصَحَّحُ (٢) المسألةُ عليهم، فإنْ كان الإِخوةُ والأخواتُ من الجِهَتَيْنِ، فالباقِى كُلُّه لوَلَدِ الأبوَيْنِ، إلَّا أنْ يكونَ ولدُ الأبوَيْنِ أُخْتًا واحدةً، فلها قَدْرُ فَرْضِها، والباقِى لهم. أمٌّ وأختٌ لأبوَيْنِ وأخٌ وأختٌ لأبٍ وجَدٌّ؛ للأُمِّ السُّدُسُ، وللجَدِّ ثُلُثُ البَاقِى، يَنْتَقِلُ إلى ثَمانِيةَ عَشْرَةَ، فللأُمِّ ثَلاثةٌ، وللجَدِّ خَمْسَةٌ، وللأُختِ للأبَوَيْنِ النِّصْفُ تِسْعَةٌ، يَبْقَى سَهْمٌ على ثلاثةٍ، فتَصِحُّ من أربعةٍ وخمسين، وتُسَمَّى مُخْتَصَرَةَ زيدٍ؛ لِأنَّه لو قاسم بالجَدِّ لانْتقَلَتْ إلى سِتَّةٍ وثلاثين،
