122 - Ahmad ibn Muhammad ibn Hazim informed us, saying: Ishaq ibn Mansur narrated to us that he asked Abu 'Abd Allah: 'Is the Sultan the guardian of those who fight against the religion?' He replied: 'If one emerges as a combatant [muharib] like these Khurramiyyah, then whatever they have obtained of that [property] belongs to the Sultan.' Ishaq ibn Rahawayh said: Just as he said, that is not permissible within the [scope of] pardon by the legal guardians; likewise, killing by treachery [ghilah] is up to the Sultan.'
١٢٢ - أَخْبَرَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ حَازِمٍ، قَالَ: ثَنَا إِسْحَاقُ بْنُ مَنْصُورٍ، أَنَّهُ قَالَ لِأَبِي عَبْدِ اللَّهِ: السُّلْطَانُ وَلِيُّ مَنْ حَارَبَ الدِّينَ، قَالَ: «إِذَا خَرَجَ مُحَارِبًا مِثْلَ هَؤُلَاءِ الْخُرَّمِيَّةِ فَمَا أَصَابُوا مِنْ ذَلِكَ فَهُوَ إِلَى السُّلْطَانِ» . قَالَ إِسْحَاقُ بْنُ رَاهَوَيْهِ: كَمَا قَالَ: لَا يَجُوزُ ذَلِكَ فِي عَفْوِ الْأَوْلِيَاءِ، كَذَلِكَ قَتْلُ ⦗١٥١⦘ الْغِيلَةِ هُوَ إِلَى السُّلْطَانِ
