128 - 'Abd Allah ibn Isma'il informed me, saying: Muhammad ibn Marja narrated to us, saying: Ahmad ibn Muhammad ibn Matar narrated to us, saying: Abu Talib narrated to us, that Abu 'Abd Allah [Ahmad ibn Hanbal] was asked about Khurramiyya who held a share in a village, then they went out to fight the Muslims, and the Muslims killed them. [He was asked:] "How do you deal with their land?" He said: "It is fay' (booty) for the Muslims. Whoever fought for it until they seized it, its one-fifth (khums) is taken and divided among five [categories], and the four-fifths belong to those who took it. The share of the commander shall be as a kharaj (land tax) for the Muslims, just as 'Umar took the Sawad (lands of Iraq) by force and endowed it for the Muslims."
١٢٨ - أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ إِسْمَاعِيلَ، قَالَ: ثَنَا مُحَمَّدُ بْنُ مَرْجَا، قَالَ: ثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ مَطَرٍ، قَالَ: ثَنَا أَبُو طَالِبٍ، أَنَّ أَبَا عَبْدِ اللَّهِ سُئِلَ عَنْ خُرَّمِيَّةٍ كَانَ لَهُمْ سَهْمٌ فِي قَرْيَةٍ فَخَرَجُوا يُقَاتِلُونَ الْمُسْلِمِينَ، فَقَتَلَهُمُ الْمُسْلِمُونَ كَيْفَ تَصْنَعُ بِأَرْضِهِمْ، قَالَ: هِيَ فَيْءٌ لِلْمُسْلِمِينَ، مَنْ قَاتَلَ عَلَيْهِ حَتَّى أَخَذَهُ، فَيُؤْخَذُ خُمُسُهُ فَيُقْسَمُ بَيْنَ خَمْسَةٍ، وَأَرْبَعَةُ أَخْمَاسٍ لِلَّذِينَ فَاءُوا، وَيَكُونُ سَهْمُ الْأَمِيرِ خَرَاجٌ لِلْمُسْلِمِينَ، مِثْلَ مَا أَخَذَ عُمَرُ السَّوَادِ عَنْوَةً، فَأَوْقَفَهُ لِلْمُسْلِمِينَ "
