148 - 'Ali ibn al-Hasan ibn Sulayman related to me, saying: Hanbal related to us, saying: I asked Abu 'Abd Allah, saying: 'A woman whom a man attempts to force, and she resists him, then she finds an opportunity and kills him to protect her chastity, is there any consequence for her in that?' He said: 'If she knows that he intended nothing but her person, and she kills him to defend herself, and he dies, then there is no consequence for her. However, if he only intended her property and clothing, then I am of the opinion that she should surrender them to him, and not take his life, because clothing and property have a substitute, whereas the human soul has no substitute.'
١٤٨ - حَدَّثَنِي عَلِيُّ بْنُ الْحَسَنِ بْنِ سُلَيْمَانَ، ثَنَا حَنْبَلٌ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ، قُلْتُ: امْرَأَةٌ أَرَادَهَا رَجُلٌ عَلَى نَفْسِهَا فَامْتَنَعَتْ مِنْهُ، ثُمَّ إِنَّهَا وَجَدَتْ خَلْوَةً فَقَتَلَتْهُ لِتُحْصِنَ نَفْسَهَا، هَلْ عَلَيْهَا فِي ذَلِكَ شَيْءٌ؟ قَالَ: «إِذَا كَانَتْ تَعْلَمُ أَنَّهُ لَا يُرِيدُ إِلَّا نَفْسَهَا فَقَتَلَتْهُ لِتَدْفَعَ عَنْ نَفْسِهَا فَمَاتَ فَلَا شَيْءَ عَلَيْهَا، وَإِنْ كَانَ إِنَّمَا يُرِيدُ الْمَتَاعَ وَالثِّيَابَ فَأَرَى أَنْ تَدْفَعَهُ إِلَيْهِ، وَلَا تَأْتِي عَلَى نَفْسِهِ، لِأَنَّ الثِّيَابَ وَالْمَتَاعَ فِيهَا عِوَضٌ، وَالنَّفْسُ لَا عِوَضَ فِيهَا»
