168 - Muhammad ibn Sulayman al-Jawhari narrated to us, [and] Abdus ibn Malik al-Attar narrated to us, saying: I heard Abu Abd Allah say: The Principles of the Sunnah. He then mentioned much discourse and said: "Fighting against highwaymen and the Khawarij is permissible. He said: And one shall not finish off [a fallen opponent] if he is thrown to the ground or is wounded. And if one captures him as a prisoner, he has no right to kill him, nor is he to execute the hadd (prescribed penalty) upon him; rather, he must refer his matter to the one whom Allah has placed in authority so that he may pass judgment."
١٦٨ - حَدَّثَنَا مُحَمَّدُ بْنُ سُلَيْمَانَ الْجَوْهَرِيُّ، ثَنَا عَبْدُوسُ بْنُ مَالِكٍ الْعَطَّارُ، سَمِعْتُ أَبَا عَبْدِ اللَّهِ، يَقُولُ: أُصُولُ السُّنَّةِ، فَذَكَرَ كَلَامًا كَثِيرًا، وَقَالَ: " قِتَالُ ⦗١٧٣⦘ اللُّصُوصِ وَالْخَوَارِجِ جَائِزٌ، قَالَ: وَلَا يُجْهِزُ عَلَيْهِ إِنْ صُرِعَ، أَوْ كَانَ جَرِيحًا، وَإِنْ أَخَذَ أَسِيرًا فَلَيْسَ لَهُ أَنْ يَقْتُلَهُ، وَلَا يُقِيمَ عَلَيْهِ الْحَدَّ، وَلَكِنْ يَرْفَعُ أَمْرَهُ إِلَى مَنْ وَلَّاهُ اللَّهُ فَيَحْكُمَ "
