172 - Abd Allah ibn Muhammad ibn Abd al-Hamid narrated to me, saying: Bakr ibn Muhammad narrated to us, from his father, from Abu Abd Allah, and I heard him say regarding fighting thieves, he said: 'I hold the view that a man should defend his wealth and fight.' He said: 'Because it is narrated from the Prophet, may Allah bless him and grant him peace: "Whoever fights for his wealth and is killed, he is a martyr." He said: "However, when the thief turns to flee, do not pursue him." I said: "Is the thief not a muharib (belligerent/highway robber)?" He replied: "You do not know whether he has killed someone or not? As for when it is a well-known, notorious thief who has committed murder and caused discord among the Muslims, then he is a muharib, and the Imam shall do with him as he wishes."
١٧٢ - وَحَدَّثَنِي عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْحَمِيدِ، ثَنَا بَكْرُ بْنُ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ أَبِي عَبْدِ اللَّهِ، وَسَمِعْتُهُ يَقُولُ فِي قِتَالِ اللُّصُوصِ، قَالَ: " أَرَى أَنْ ⦗١٧٥⦘ يَدْفَعَ الرَّجُلُ عَنْ مَالِهِ وَيُقَاتِلَ، قَالَ: لِأَنَّهُ يُرْوَى عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ قَاتَلَ دُونَ مَالِهِ فَقُتِلَ فَهُوَ شَهِيدٌ» قَالَ: وَلَكِنْ إِذَا وَلَّى اللِّصُّ لَا تَتَّبِعْهُ، قُلْتُ: أَلَيْسَ اللِّصُّ مُحَارِبًا؟ قَالَ: أَنْتَ لَا تَدْرِي قَتَلَ أَمْ لَا؟ فَأَمَّا إِذَا كَانَ لِصٌّ مَعْرُوفٌ مَشْهُورٌ أَنَّهُ قَدْ قَتَلَ وَشَقَّ عَصَا الْمُسْلِمِينَ، فَهُوَ مُحَارِبٌ، يَفْعَلُ بِهِ الْإِمَامُ مَا أَحَبَّ "
