339 - Al-Walid said: I said to Abu 'Amr: What is your opinion if water is in front of me on my path, and the time for prayer has entered? He said: "Delay the prayer until the end of the time, then dismount, perform tayammum, and pray."
340 - Al-Walid said: I asked Malik, and he said the same.
341 - Al-Walid said: It was said to Abu 'Amr: A man whose time for prayer has arrived, and he does not expect to find water in front of him? He said: "Let him perform tayammum and pray the prayer at the beginning of its time." It was said to Abu 'Amr: What about someone who wakes up or becomes aware while he is in a state of janaba (major ritual impurity), such that if he were to perform ghusl (full washing) or wudu, the sun would rise or set? He said: "He should perform tayammum and perform the prayers before their time expires."
342 - Al-Walid said: I mentioned this to Ibrahim ibn Muhammad al-Fazari, and he informed me from Sufyan al-Thawri, who said: "He performs tayammum and prays."
343 - Al-Walid said: I mentioned that to Malik ibn Anas, Ibn Abi Dhi'b, and Sa'id ibn 'Abd al-'Aziz; they said: "Rather, he should perform ghusl and pray, even if the sun rises upon him, due to the saying of Allah the Exalted: {Then you do not find water}. This person is a finder of water; he had an excuse regarding his sleep, his negligence, or his forgetfulness; he is excused for that."
344 - Al-Walid said: It was said to Abu 'Amr: What about a man who is not in a state of wudu and passes by water before the time for prayer, and he knows that if he passes it before he performs wudu, he will not find water? He said: "Let him perform wudu." It was said to Abu 'Amr: What if he did not perform wudu until he passed it and the time for prayer arrived, and he found no water? He said: "He should perform tayammum and pray, and there is no repetition [of the prayer] upon him when he finds water, because he had passed by the water before the time of prayer."
