It was said to Abu 'Amr: What if he passed by water at the time of prayer, and he passed it while thinking that there was water in front of him—without certainty—but then he found no water? He said: "He should perform tayammum and pray, and there is no repetition upon him due to his ignorance of the terrain."
It was said to Abu 'Amr: What if he passed by water at the time of prayer while he was not in a state of wudu, and he knew that he would not find any other water in front of him? He said: "He acted wrongly, yet he should perform tayammum and pray, and he is obligated to repeat that prayer when he finds water, both within the time [of the prayer] and after the time."
It was said to Abu 'Amr: What if he performed tayammum and prayed, then passed by water but forgot to perform ghusl until another prayer time arrived, and he found no water, so he performed tayammum and prayed, and then found water after the time [had expired]? He said: "His prayer is valid, according to the saying of the Messenger of Allah, peace and blessings of Allah be upon him: 'Indeed, Allah has pardoned for my ummah [their] mistakes and forgetfulness.'"
Chapter: Regarding one who performs tayammum and prays, then finds water within the time of prayer.
• It was said to Ahmad: What about a man who performs tayammum and prays, then finds water within the time of prayer? It was as if he preferred that he repeat the prayer, but if he does not repeat it, we do not see any obligation upon him.
• And I heard Ishaq say: "If you perform tayammum and pray, then you find water while you have already prayed, then your prayer has passed; it is a past sunnah."
345 - Muhammad ibn Nasr narrated to us, he said: Hassan ibn Ibrahim narrated to us, from Sufyan ibn Sa'id, from Muhammad ibn 'Ajlan, from Nafi', from Ibn 'Umar, that he performed tayammum at a distance of one or two miles from Medina, then prayed Asr, then arrived [in the city] while the sun was still high, and he did not repeat the prayer.
قيل لأبي عَمرو: فإنه مَرَّ بِماءٍ في ميقات الصَّلاة، فَجاوَزَه وهو يَظُنُّ أن بَين يَدَيه ماءً -مِن غَير يَقين-، فَلَم يَجِد ماءً؟ قال: «يَتيَمَّم ويُصَلِّي، ولا إعادَة عَلَيه؛ لِجَهالَته بالبَلَد».
قيل لأبي عَمرو: فإنه مَرَّ بالماء في وَقت الصَّلاة وهو على غَير وضوء، وهو يَعلَم أنه لا يَجِد بَين يَدَيه ماءً غَيره؟ قال: «أَساء، ويَتيَمَّم ويُصَلِّي، وعَلَيه قَضاء تِلك الصَّلاة إذا وَجَدَ الماء في الوَقت وغَير الوَقت».
قيل لأبي عَمرو: فإنه تَيمَّم وصَلَّى ثم مَرَّ بالماء، فَنَسي أن يَغتَسِل حتى حَضَرَته صلاةٌ أُخرَى، فَلَم يَجِد ماءً، فَتيَمَّم، ثم صَلَّى، ثم وَجَد الماء بَعد الوَقت؟ قال: «مَضَت صلاته؛ لقول رسول الله صلى الله عليه وسلم: «إن الله تَجاوز لِأُمَّتي الخَطَأ والنِّسيان»».
باب: مَنْ تَيَمَّم وصَلَّى، ثم أَدرَك الماءَ في وَقت الصَّلاة
• قيل لأحمد: فَرَجلٌ تَيمَّم وصَلَّى، ثم أَدرَك الماءَ في وَقت الصَّلاة؟ فكَأنه أَحَبَّ أن يُعيد الصَّلاة، وإن لم يُعد؛ لم نَرَ عَلَيه شيئًا.
• وسمعت إسحاق يقول: «إذا تَيمَّمت فَصَلَّيت، ثم وَجَدت الماء وقد صَلَّيت؛ فقد مَضَت صلاتك؛ سُنةٌ ماضيَة».
٣٤٥ - حدثنا محمد بن نصر، قال: ثنا حَسَّان بن إبراهيم، عن سُفيان بن سَعيد، عن محمد بن عجلان، عن نافع، عن ابن عُمَر، أنه تَيمَّم على رَأس ميلٍ أو ميلَين من المدينة، فَصَلَّى العَصر، ثم قَدِمَ والشَّمس مرتفعة، فَلَم يُعِد.
