346 - Mahmud ibn Khalid narrated to us, he said: Al-Walid ibn Muslim narrated to us, he said: Abu 'Amr al-Awza'i narrated to us, from Ibn Shihab al-Zuhri and Yahya ibn Sa'id—and he asked them about a man who performs tayammum then prays, then finds water within the time [of the prayer]—they said: "We do not believe he should repeat it."
347 - Mahmud narrated to us, he said: Al-Walid narrated to us, from al-Awza'i and Sa'id ibn 'Abd al-'Aziz, from Makhul, he said: "He should repeat it within the time."
348 - He said: And al-Walid narrated to us, from Sa'id ibn Bashir, from al-Hasan; similar to that.
349 - Al-Walid said: And Abu 'Amr said: "My opinion is that he should repeat it within the time, though it is not a duty upon him."
Chapter: A person who performs tayammum, prays one rak'ah, then sees water.
• It was said to Ahmad: A man performs tayammum and prays one rak'ah, then sees water? He said: "I prefer ease in this regard; it is narrated from Malik that he said: 'He should continue.'" Ahmad said: "He likened it to the fasting of an expiation (kaffarah) if one has begun it, then becomes affluent; he continues in his fasting."
• And I asked Ishaq—another time—he says: "If you find water while you are in your prayer, do not complete it; rather, desist, perform wudu, and repeat the prayer." He said: "Desisting is more beloved to us. As for Malik, the general body of the Hijaz scholars, and those from the people of Iraq who follow their path; they believe that if one sees water while he is in prayer, he should continue in it, because his commencement was valid. Just as they said regarding one who proceeds with an expiation for an oath (yamin) or zihar (dhihar); he proceeds with the fast when he does not find [the means], then if he finds it before finishing, he continues with his fast. They say: It is only upon him to seek [water] in a state where his prayer is invalidated. So it is an opinion that resembles the Sunnah, except that what we described first is more beloved to us due to what al-Hasan ibn Abi al-Hasan adopted, and what al-Thawri, Ibn al-Mubarak, and those who follow their path saw. All are valid schools of thought, and Allah knows best."
