356 - Ahmad ibn al-Azhar narrated to us, saying: Abu al-Abbas al-Dimashqi narrated to us, from al-Awza'i; he said: He was asked about the person suffering from smallpox (al-majdur), should he perform tayammum with the earth? He said: "Yes, if he fears for his life."
And he was asked about the sick person also performing tayammum? He said: "The sick person who has no one with him to hand him water, and is unable to stand... (1)"
In a case of extreme cold, he asked for a legal opinion, and he was told to perform ghusl (full body wash). He became rigid and died. This reached the Prophet, peace and blessings be upon him, and he said: "They killed him, may Allah kill them! The cure for ignorance is the question."
Chapter: Tayammum while present (in the city/not traveling)
• I said to Ishaq ibn Ibrahim: What about a man from the city who is a farsakh away, and he is not on a journey, and the time for prayer arrives, and he does not have water; should he perform tayammum and pray? He said: "Yes, he should perform tayammum and pray." I said: And should he repeat it? He said: "No, and I hold the opinion that tayammum is permissible while present (in the city)."
(1) This speech overlapped with the following hadith in the original, and it is likely due to the copyist's eye jumping, and the correct approach is to separate them.
٣٥٦ - حدثنا أحمَد بن الأزهَر، قال: ثنا أبو العَبَّاس الدِّمشقي، عن الأوزاعي؛ قال: سُئل عن المَجدور، أيَتَيمَّم بالصَّعيد؟ قال: «نَعم، إذا أَشفَق على نَفسِه».
وسُئل عن المريض يَتَيمَّم -أيضًا-؟ قال: «المريض الذي لَيسَ عِنده أَحَدٌ يُناوِلُه الماء، ولا يَستَطيع أن يَقوم ... (١)».
o في بَردٍ شَديد، فَاستَفتَى، فَأُفتي أن يَغتَسِل، فَكُزَّ فَمات، فَبَلَغَ النبيَّ صلى الله عليه وسلم، فقال: «قَتَلوه قَتلَهم الله، إنما شِفاء العِيِّ السُّؤال».
باب: التَّيَمُّم في الحَضَر
• قلت لإسحاق بن إبراهيم: فَرَجلٌ من المدينة على فَرسَخ، وليس في سَفَر، فَحَضَرَت الصَّلاة، ولَيسَ له ماء، أيَتَيمَّم ويُصَلِّي؟ قال: «نَعم، يَتيَمَّم ويُصَلِّي». قلت: وَيُعيد؟ قال: «لا، وأنا أَرَى في الحَضَر التَّيمُّمَ».
