381 - Mahmud narrated to us, saying: Al-Walid narrated to us, saying: Abu 'Amr al-Awza'i was asked about a group of people who woke up without wudu, and they had only enough water for one wudu. He said: "They should contend for it." It was said to Abu 'Amr: What if one of them reaches it before the others to be more entitled to it? He said: "No, and it is more beloved to me that they prioritize their Imam with it."
It was said to Abu 'Amr: What about a woman who became pure from her menses, and her husband woke up in a state of janaba (major ritual impurity), and they have only enough water between them for one ghusl (full body wash)? He said: "The menstruating woman (who has become pure) is more entitled to it if the water is shared between them. But if it belongs to the person in janaba, he should not give it to the woman."
It was said to Abu 'Amr: [Regarding a conflict between a janaba bath and washing the dead] (1). He said: "The ghusl for janaba is an obligation (faridah), and washing the deceased is a sunnah; therefore, the one in janaba is more entitled to it."
Chapter: He who performs tayammum and is afflicted by urine or impurity
(1) The scribe left a blank space for a word and marked it with a smudge. It is understood from the context that the issue concerns water sufficient for only one ghusl, for which a person in janaba and the washing of a deceased person are competing; which of them is more entitled to it?
