Masa'il Harb al-Kirmani: Book of Purification (Taharah) and Prayer (Salah) - Edited by al-Surayyi'
Volume 1 · Page 219

Translation · EN

552 - Abu al-Azhar narrated to us, saying: Muhammad ibn Yusuf narrated to us, saying: Sufyan said: 'When a woman first menstruates, she should sit [for] menses [for a period] similar to [that of] her female relatives.'

553 - Muhammad ibn Nasr narrated to us, saying: Hassan ibn Ibrahim narrated to us, saying: Abu Hanifa wrote to me, and Zafar said, regarding a woman who had never menstruated until she became a mustahada (suffering from irregular bleeding): 'We look to the time [typical for] her female relatives; if she is a captive whose female relatives' time we do not know, then the first thing she sees of blood is menses, [for a duration of] between her and ten days, then she performs ghusl and prays, and performs wudu for every prayer for [the duration of] between her and twenty days, then she is considered menstruating after the twenty [days] for ten [days]; this is the time of menses for her.'

  • And I heard Ishaq ibn Ibrahim say—regarding this opinion: 'Ha' (an expression of disapproval), and the error is evident regarding the virgin. Had they said: "We choose for her to sit for the duration most common for women's sitting for menses, which is seven days or something similar; because the Prophet, peace and blessings be upon him, ordered Hamna bint Jahsh, at the time of the confusion of her menses, to sit for seven days and [count] twenty-three days as purity, thus making the menses and purity cover the entire month, in accordance with the Book and the Sunnah," it would have been better than what they said: "We reach with her ten [days]," which is also, according to them, the [duration of] women's menses.'

Notes

(1) Thus it is in the original, and perhaps it is a corruption of: "ja'u bi-khata'" (they brought an error). Warning: What is between the parentheses is what the editor has corrected based on the printed edition.
