Masa'il Harb al-Kirmani: Book of Purification (Taharah) and Prayer (Salah) - Edited by al-Surayyi'
Volume 1 · Page 246Chapter: A woman who menstruates for more than fifteen days

Translation · EN

Harb said: "This is according to the meaning of the statement of Ibn al-Mubarak: three [days of] menstruation, ten [days of] purity, three [days of] menstruation, ten [days of] purity, and three [days of] menstruation."

600 - Ishaq narrated to us, saying: Muhammad ibn Bakr informed us, saying: Sa'id ibn Abi 'Arubah narrated to us, from Qatadah, from 'Uzrah, from al-Hasan al-'Urani, that a woman's husband divorced her, and she menstruated three times in thirty-five nights. She was referred to Shurayh, but he did not know what to say regarding her and did not say anything. So they were referred to Ali ibn Abi Talib, who said: "Ask her female neighbors about her; if her menstruation is indeed like this, then her 'iddah has completed, otherwise [it is] three months."

Chapter: The woman who menstruates for more than fifteen days

I heard Ishaq say: "From some of the scholars: that a woman used to see blood for seventeen days as a moderate menstruation in the month. Others said: Some of the women of the Majishun would remain [without prayer] for twenty days. Malik disapproved of this and said: 'She does not menstruate for more than half of her lifetime.' I do not see that which exceeds fifteen days, yet I do see—if that happens, such that it is known for a woman and she sees that at the time of her periods—that she should be judged according to her own state, due to what the Prophet, peace and blessings of Allah be upon him, commanded: 'Sit for the days of your menstrual cycles,' thus returning each woman to her own nature. Although I suspect that this only happens due to irregularity—she menstruates seventeen [days] once, less another time, and more another time. So if that enters into the time and there is no authentic Sunnah or consensus of the scholars regarding it, we return to the consensus of the scholars and what they have comprehended: fifteen days. This is what Ibn Mahdi and his peers among the scholars chose, unless what exceeds fifteen days is, as we described, a known matter in every month."

Notes

(1) Thus it appears in the original, and the appropriate [form] is "amran ma'rufan" (a known matter).
