• I heard Ishaq once again saying regarding the woman in postpartum confinement: "If she becomes pure in seven days or less, she shall perform ghusl (full ablution), pray, and fast, but her husband shall not have intercourse with her until forty days have passed. This is considered a precautionary measure for her by the people of knowledge."
674 - Muhammad ibn al-Wazir narrated to us, saying: Marwan ibn Muhammad narrated to us, saying: I asked Sa'id ibn 'Abd al-'Aziz and Malik ibn Anas about the woman in postpartum confinement: When does she pray? They said: "If she has known in the past how long she used to remain in blood, she should take the maximum of that, then perform ghusl and pray." It was said: "What if she sees purity in fifteen [days]?" They said: "She performs ghusl and prays." It was said: "May her husband have intercourse with her?" They said: "When prayer becomes permissible for her, intercourse becomes permissible."(1)
675 - 'Amr ibn 'Uthman narrated to us, saying: al-Walid ibn Muslim narrated to us, from al-Awza'i regarding a woman who gave birth to a child and did not see any blood upon her, neither little nor much: He said: "She performs ghusl and prays."
676 - al-Walid said: I said to Malik: "Does she have to perform ghusl even though she did not see blood, neither little nor much?" He said: "Yes."
677 - 'Abd Allah ibn Muhammad ibn Asma' narrated to us, saying: Mahdi ibn Maymun narrated to us, from Jald ibn Ayyub, from Abu Iyas Mu'awiyah ibn Qurrah, from 'A'idh ibn 'Amr, that his wife was in postpartum confinement and she saw purity in twenty nights, so she purified herself and came to his bed. He said: "What is the matter with you?" She said: "I have purified myself." He said: "You have hurried it." He said: "Stay away from me, for you are tempting me away from my religion(2) until forty nights have passed for you."
(1) Thus it is in the original, using the singular verb "qala" (he said) in all instances. (2) Thus it is in the original, and perhaps the correct phrasing is: "Ilayki 'anni, falasti bi-allati" (Stay away from me, for you are not one who...)
• سمعت إسحاق -مرةً أخرى- يقول -في النُّفَساء-: «إن طَهُرَت في سَبعَة أيام أو أَقَلّ؛ اغتَسَلَت وصَلَّت وصامَت، ولا يأتيها زَوجها حتى تَمضي الأربَعون، وذلك من أهل العِلم احتياطًا لَها».
٦٧٤ - حدثنا محمد بن الوَزير، قال: ثنا مَروان بن محمد، قال: سألت سَعيد بن عبد العَزيز ومالك بن أنس عن النُّفَساء، متى تُصَلِّي؟ قال: «إن كانت قد عَرَفَت فيما خَلا كَم كانت تَمكُث في الدم؛ فلتَأخُذ بأقصَى ذلك، ثم تَغتَسِل وتُصَلِّي». قيل: فإن رَأَت طُهرًا في خَمسَ عَشرَة؟ قال: «تَغتَسِل وتُصَلِّي». قيل: فيُجامِعها زَوجها؟ قال: «إذا حَلَّت الصَّلاة حَلَّ الجِماع» (١).
٦٧٥ - حدثنا عَمرو بن عُثمان، قال: ثنا الوَليد بن مُسلِم، عن الأوزاعي -في امرأةٍ وَلَدَت وَلَدًا، فلم تَرَ عَلَيها من الدم قَليلًا ولا كَثيرًا-؛ قال: «تَغتَسِل وتُصَلِّي».
٦٧٦ - قال الوَليد: قلت لمالك: وعَلَيها الغُسل ولم تَرَ دَمًا قَليلًا ولا كَثيرًا؟ قال: «نعم».
٦٧٧ - حدثنا عبد الله بن محمد بن أسماء، قال: ثنا مهدي بن ميمون، عن جلد بن أيوب، عن أبي إياس مُعاويَة بن قرة، عن عائذ بن عَمرو، أن امرأته نَفسَت، وأنها رَأَت الطُّهر في عِشرين لَيلَة، فتَطَهَّرَت، ثم أَتَت فِراشَه، فقال: «ما شأنكِ؟». قالت: «قد تَطَهَّرت». قال: «قَصرتِ بها». فقال: «إليكِ بالذي (٢) تَغُرِّيني عن ديني، ⦗٣٣٤⦘ حتى تَمضي بِكِ أربَعون لَيلَة».
