693 - Ishaq said: Likewise, al-Walid ibn Muslim informed me, from al-Awza'i, from al-Zuhri, who said: "If a man buys a slave girl who menstruates, and her menstruation ceases, he must observe her istibra' (waiting period to establish non-pregnancy) for three months."

694 - 'Amr ibn 'Uthman narrated to us, saying: al-Walid ibn Muslim narrated to us, from al-Awza'i—regarding an elderly woman who has despaired of menstruation but experiences irregular bleeding—he said: "She does what a woman suffering from irregular bleeding (mustahadah) does."

Chapter: The Elderly Woman Who Sees Blood

695 - Hannad narrated to us, saying: Waki' narrated to us, from Sufyan, from Ibn Jurayj, from 'Ata'—regarding an elderly woman who sees blood—he said: "She is in the position of a woman suffering from irregular bleeding (mustahadah)."

696 - Muhammad ibn 'Abd al-A'la narrated to us, saying: Khalid ibn al-Harith narrated to us, saying: Ash'ath informed us, from al-Hasan—regarding a woman who has reached menopause and sees blood—he said: "She is in the position of a woman suffering from irregular bleeding (mustahadah)."

Chapter: Having Intercourse with a Menstruating Woman

• I asked Ahmad and said: A man who has intercourse with a menstruating woman? He said: "If he has the capacity, then upon him is what has come [in the reports] from the Prophet, peace and blessings of Allah be upon him." I said: A dinar or half a dinar? He said: "Yes."

• And I asked Ishaq and said: A woman who did not inform her husband that she was menstruating, so he had intercourse with her? He said: "Upon him is a dinar if it was during the onset of the blood, and if it was yellow discharge, then half a dinar. Likewise, the woman is liable for a dinar and more, because she is the one who deceived him. If the husband forced her, then there is nothing upon her." It was said to Ishaq: What if the man did not know that she was menstruating and had intercourse with her? He said: "Upon him is a dinar for his act of intercourse, not for his knowledge."
