702 - Hannad narrated to us, Waki' narrated to us, from al-Rabi', from al-Hasan, who said: "If a man approaches his wife while she is menstruating, he must emancipate a slave, or offer a camel as a sacrifice (badana), or feed twenty sa's (to) forty poor people."
703 - 'Ali ibn 'Uthman narrated to us, saying: Malik ibn al-Khattab narrated to us, saying: I heard 'Abd Allah when a man asked him about a man who approaches his wife while she is menstruating? He said: "I know of nothing for that, except that he should seek forgiveness from Allah and repent."
704 - Muhammad ibn al-Wazir narrated to us, saying: al-Walid ibn Muslim narrated to us, saying: al-Muthanna ibn al-Sabbah narrated to us, that he heard 'Ata' say regarding a man who has intercourse with his wife while she is menstruating; he said: "He should seek forgiveness from Allah."
705 - al-Walid said: "And this is the opinion of Malik and the people of Medina; that it is a forbidden act he has transgressed, and we know of no expiation (kaffarah) for him other than repentance and seeking forgiveness."
Chapter: The Woman Suffering from Istihadah (Non-menstrual bleeding) and Her Husband Approaching Her
• I asked Ahmad, I said: May a husband have intercourse with a woman suffering from istihadah? He said: "No, unless he cannot restrain himself."
• And I heard Ishaq say: "As for having intercourse with a woman suffering from istihadah, the preferred view regarding that is: If she knows the days of her menstrual cycles, then she suffers from istihadah, and her menstrual bleeding does not become mixed with her istihadah bleeding, and she has adopted caution regarding prayer according to the saying of the scholars, and she has determined the times of her menstrual period from her istihadah, but has not attained certainty in that: then her husband should not approach her until she is certain of her istihadah."
(1) The following is missing here: "that her husband may have intercourse with her, and she should pray and fast, and if her menstrual blood becomes mixed with her istihadah blood."
