Translation · EN

Chapter: A woman sees the sign of purity; may her husband approach her?

• Ishaq said: "As for what these people say—that if she becomes pure from menstruation and washes, then blood comes out, it is permissible to have intercourse with her—this is a clear error, because of what Allah—the Exalted—said: {But when they have purified themselves, then come to them from where Allah has ordained for you}. The scholars among the Tabi'un and those whom we have described are in consensus that he should not have intercourse with her until she performs ghusl."

709 - Ishaq narrated to us, saying: Jarir informed us, from 'Abd al-Malik, from 'Ata'—regarding a woman who sees the sign of purity, may her husband approach her?—he said: "No, not until she performs ghusl."

710 - Ishaq narrated to us, saying: 'Abdullah ibn Yazid narrated to us, saying: Haywah ibn Shurayh narrated to us, saying: I heard Yazid ibn Abi Habib say: Abu al-Khayr Marthad ibn 'Abdullah al-Yazani said: I heard 'Uqbah ibn 'Amir say: "By Allah, I will not have intercourse with my wife on the day she becomes pure, until a day passes for her."

Chapter: A man fondles his wife while she is menstruating

• I asked Ahmad, saying: A man fondles his wife while she is menstruating, and he is wearing an izar (waist wrapper), but she is not? He said: "I hope there is no harm in it. We do not see any harm in fondling a menstruating woman in any state, and we see that there is no harm in him touching what he wishes of her, provided he avoids the place of the blood."

• And I heard Ishaq say: "As for the concession for men in fondling a menstruating woman and touching her without the private parts, the scholars are in consensus on that. No one among the scholars has granted a concession for him to have intercourse with her when she is pure from her menstruation before she performs ghusl, because ghusl is an obligation upon her in the Book (Quran), and the Sunnah has proceeded accordingly."
