761 - al-Walid said: And Malik ibn Anas informed me - regarding a man who led a people in prayer, but forgot the opening Takbir (Takbirat al-Ihram) until he finished his prayer - he said: "I believe the Imam and those behind him must repeat the prayer." Malik said: "Even if those behind him had said the Takbir, they must still repeat it."
762 - al-Walid said: And Khulayd informed me, from al-Hasan and Qatadah, they both said: "If you forget the opening Takbir, but you say the Takbir for bowing while you are with the Imam, then your prayer is valid (has passed)."
763 - al-Walid said: And Abu 'Amr al-Awza'i said - regarding one who forgets the opening Takbir: "If he is alone, he must restart the prayer. If he is with the Imam, the Takbir for bowing suffices him, and he is like one who caught the Imam's bowing, so he says one Takbir, places his palms upon his knees, and then the Imam raises his head; that rak'ah suffices him, and he says the Takbir when he remembers."
764 - al-Walid said: I said to Abu 'Amr: What if he forgets both the opening Takbir and the Takbir for bowing? He informed me that Ibn Shihab al-Zuhri said: "He should add a rak'ah to his prayer and not count that rak'ah for which he did not say the Takbir."
And Abu 'Amr said: "If he is alone and forgets the first and the last [Takbir], he must repeat the prayer. But if he is with the Imam, he adds another rak'ah to his prayer."
٧٦١ - قال الوَليد: وأخبرني مالك بن أنس -في رَجلٍ أمَّ قَومًا، فَسَها عن تكبيرة الإحرام حتى فَرَغَ من صلاته-؛ قال: «أرى أن يُعيدُ الإمامُ ومَنْ خَلفَه الصَّلاة»، قال مالك: «وإن كان الذي خَلفَه قد كَبَّروا؛ فإنهم يُعيدون».
٧٦٢ - قال الوَليد: وأخبرني خليد، عن الحسَن وقَتادَة، قالا: «إن نَسيتَ تكبيرة الاستِفتاح، وكَبَّرتَ للركوع وأنت مع الإمام؛ فقد مَضَت صلاتك».
٧٦٣ - قال الوَليد: وقال أبو عَمرو الأوزاعي -فيمن نَسي تكبيرة الاستِفتاح-: «إن كان وَحدَه استأنَف الصَّلاة، وإن كان مع الإمام أجزأته تكبيرة الركوع، وكان كَمَنْ أدرَك رَكعةَ الإمام، فكَبَّر تكبيرةً، وأمكَنَ كَفَّيه من رُكبَتَيه، ورَفَعَ الإمام رأسَه؛ فقد أجزأته تلك الركعة، ويُكبِّر إذا ذَكَر».
٧٦٤ - قال الوَليد: قلت لأبي عَمرو: فإن نَسي تكبيرة الاستِفتاح وتكبيرة الركوع؟ فأخبرني أن ابن شِهاب الزُّهري قال: «يُضيفُ إلى صلاته ركعة، ولا يَعتَدُّ بتلك الركعة التي لم يُكبِّر لها».
وقال أبو عَمرو: «إذا كان وَحدَه، فَنَسي الأولى والآخرة؛ أعاد الصَّلاة، وإذا كان مَعَ الإمام؛ أضاف إلى صلاته ركعةً أخرى».
