1140 - Abbas ibn al-Walid narrated to us, saying: Umar ibn 'Abd al-Wahid narrated to us, saying: I asked al-Awza'i about a man who drank wine, then stood and prayed; should he repeat his prayer? He said: "No." I said: "But he is drunk?" He said: "He must repeat his prayer."
1141 - Ibn Abi Hazm al-Quta'i narrated to us, saying: Mu'adh ibn Mu'adh narrated to us, saying: Ash'ath narrated to us, from al-Hasan—regarding the drunk person who leads a people in prayer—he said: "If he completes the bowing (ruku') and the prostration (sujud), then it suffices for them."
1142 - And Muhammad ibn Sirin said: "They all must repeat, including the imam."
1143 - Ibn Abi Hazm al-Quta'i narrated to us, saying: Kathir ibn Hisham narrated to us, saying: Ja'far ibn Burqan narrated to us, saying: I asked Maymun ibn Mihran about the prayer of the drunk person? He said: "It is valid for him, and the prescribed punishment (hadd) is not carried out [on him for the prayer itself]."
Chapter: Prayer Behind a Slave
• Ishaq was asked about praying behind a slave? He said: "There is no harm in it."
• He said: "And his testimony is valid if he is upright (adl)."
(1) Thus it is in the original, and perhaps the more correct reading is: "yu'idun" (they repeat).
١١٤٠ - حدثنا عَبَّاس بن الوَليد، قال: ثنا عُمَر بن عبد الواحِد، قال: سألت الأوزاعي عن رَجلٍ شَرِبَ خَمرًا، ثم قام فصَلَّى؛ أيُعيدُ صَلاته؟ قال: «لا». قلت: فإنه سَكران؟ قال: «يُعيدُ صَلاته».
١١٤١ - حدثنا ابن أبي حَزم القُطَعي، قال: ثنا مُعاذ بن مُعاذ، قال: ثنا أشعَث، عن الحسَن -في السَّكران يَؤمُّ القَوم-؛ قال: «إذا أتَمَّ الركوعَ والسُّجود؛ فقَد أجزأ عَنهم».
١١٤٢ - وقال محمد بن سيرين: «يعودون (١) جَميعًا والإمام».
١١٤٣ - حدثنا ابن أبي حَزم القُطَعي، قال: ثنا كثير بن هِشام، قال: ثنا جَعفَر بن برقان، قال: سألت ميمون بن مهران عن صَلاة السَّكران؟ فقال: «تَجوز عَلَيه، ولا يُضرَب الحَدّ».
باب: الصَّلاة خَلفَ العَبْد
• وسُئل إسحاق عن الصَّلاة خَلفَ العَبد؟ قال: «لا بأس».
• قال: «وشَهادَته جائزَةٌ إذا كان عَدلًا».
