1172 - Abd al-Rahman ibn Muhammad ibn Salam narrated to us, saying: Ya'qub ibn Ishaq narrated to us, saying: Hajib ibn Umar narrated to me, saying: al-Hakam ibn al-A'raj narrated to me that a man arrived with teak wood of his, and Ziyad bargained with him for it, but he did not sell it to him, so he usurped it from him and built with it a shelter (zullah) in the mosque. He (the narrator) said: "Abu Bakrah was never seen praying in it until it was demolished."
Chapter: A Mosque Built on the Road
• I said to Ahmad: "And a mosque built on the road?" He said: "It should be torn down, and the road should be returned to what it was."
1173 - al-Musayyab ibn Wadih narrated to us, saying: Ibn al-Mubarak narrated to us, from Mis'ar, from Jami' ibn Shaddad, from Ziyad ibn Hudayr, who said: I heard Umar ibn al-Khattab (may Allah be pleased with him) saying: "Let me not hear of anyone who diminished anything from the paths of the people or their benefits, otherwise I will do and do (i.e., punish him severely)."
Chapter: A Mosque Falling into Disrepair; Its Wood Being Removed and Another Built in Its Place
• I said to Ahmad: "A man built a mosque, and the call to prayer was made in it, then they tore down this mosque and built another mosque in another place, and they moved the wood of this old mosque to that mosque?" He said: "They should repair this other, old mosque and not leave it abandoned." I said: "If this mosque falls into ruin, may a house or an inn for travelers (khan al-sabil) be built in its place?" He said: "No, rather it should be repaired and looked after, provided that the call to prayer had been made in it previously and prayer had been held."

١١٧٢ - حدثنا عبد الرحمن بن محمد بن سلام، قال: ثنا يَعقوب بن إسحاق، قال: حدثني حاجب بن عُمَر، قال: حدثني الحكم بن الأعرج، أن رَجلًا قَدِمَ بِساجٍ لَه، فساوَمَ به زياد، فلم يَبِعه منه، فغَصَبَه إيَّاه، فبَنى بِه ظُلَّةً في المسجِد. قال: «فما رُئي أبو بَكرَة صَلَّى فيه حتى هُدِمَت».
باب: المسجِد يُبنَى على الطَّريق
• قلت لأحمد: ومَسجِدٌ بُني على الطَّريق؟ قال: «يُقلَع، ويُرَدُّ الطَّريق إلى ما كان».
١١٧٣ - حدثنا المسيَّب بن واضِح، قال: ثنا ابن المبارَك، عن مسعر، عن جامع بن شداد، عن زياد بن حدير، قال: سمعت عُمَر بن الخطاب -رضي الله عنه- يقول: «لا أعرِفَنَّ أحَدًا انتَقَصَ من سُبُل الناس أو من مَنافِعِهم شَيئًا؛ إلا فَعَلتُ وفَعَلت».
باب: المسجِد يَخرب، فيُقلَع خَشَبُه، ويُبنَى مَكانَه آخَر
• قلت لأحمد: رَجلٌ بَنى مَسجِدًا، فأُذِّن فيه، ثم قَلَعوا هذا المسجِد، وبَنَوا مَسجِدًا آخَر في مَكانٍ آخَر، ونَقَلوا خَشَبَ هذا المسجِد العَتيق إلى ذلك المسجِد؟ قال: «يَرُمُّوا (١) هذا المسجِد الآخَر العَتيق، ولا يُعَطِّلوه». قلت: فإذا خَرِبَ هذا المسجِد؛ يُبنَى مَكانَه بَيتٌ أو خانٌ للسَّبيل؟ قال: «لا، ولكن يُرَمُّ ويُتعاهَد إذا كان قَد أُذِّن فيه قَبلُ وصُلِّي».
