Translation · EN

141 - Isa ibn Muhammad narrated to us, he said: Muhammad ibn Yusuf narrated to us, from Sufyan, from Harithah ibn Abi al-Rijal, from 'Amrah, from 'Aishah (may Allah be pleased with her), who said: "I used to perform ablution, I and the Messenger of Allah (may Allah bless him and grant him peace), from a vessel from which a cat had drunk before that."

Chapter: The leftover water (su'r) of a donkey

  • Ahmad ibn Hanbal was asked about a man who finds the leftover water of a donkey; should he perform ablution with it or perform tayammum? He said: "He performs both ablution and tayammum."

142 - And Muhammad ibn Yahya al-Quta'i narrated to us, he said: 'Abd al-A'la narrated to us, he said: Yunus narrated to us, from al-Hasan, that he saw no harm in the leftover water of a donkey.

  • I heard Ishaq ibn Ibrahim saying: "If he finds no water except the leftover water of a mule, a donkey, or all other animals whose meat is not eaten, or that which is from beasts of prey, he performs ablution with it. Ablution with the leftover water of a mule, a donkey, and all other animals is permissible if it is out of necessity, and he does not perform tayammum along with it, because he only used it due to the state of necessity, and the matter in which there is disagreement is more beloved to me than performing tayammum.

As for the one who said: 'He performs tayammum along with it,' that is a clear error. For if the leftover water of a donkey, mule, and beasts of prey were impure, and you performed ablution with it, you would have added impurity to the areas of your ablution, and it has indeed increased. Tayammum does not purify impurities; tayammum is a purification in place of water. If you had performed ablution then performed tayammum due to the leftover water of the donkey, you would have removed your tayammum with the water and the filth upon you; thus, from this perspective, we disliked that one should combine them. What we choose from that is: that he performs ablution with it."

١٤١ - حدثنا عيسَى بن محمد، قال: ثنا محمد بن يوسُف، عن سُفيان، عن حارِثة بن أبي الرِّجال، عن عَمْرَة، عن عائشَة -رضي الله عنها-، قالت: «كنت أتوضَّأ أنا ورسول الله صلى الله عليه وسلم من إناءٍ قد أَصَابَ مِنه الهِرُّ قَبلَ ذلك».

باب: سُؤر الحِمار

• سُئل أحمَد بن حَنبل عن رَجلٍ أَصَاب سُؤرَ حِمار، أيتوضَّأ أم يَتيَمَّم؟ قال: «يتوضَّأ ويَتيَمَّم».

١٤٢ - وحدثنا محمد بن يَحيى القُطَعي، قال: ثنا عبد الأعلى، قال: ثنا يونُس، عن الحسَن، أنه كان لا يَرى بِسُؤر الحِمار بأسًا.

• سمعت إسحاق بن إبراهيم يقول: «إن لم يَجِد ماءً إلا سُؤر البَغل والحِمار أو سَائر الدَّوابِّ التي لا يُؤكَل لَحمُها أو ما كان من السِّباع؛ فإنه يتوضَّأ بِه، والوضوء من سُؤر البَغل والحِمار وسَائر الدَّوابِّ جائزٌ إذا كان من ضَرورَة، ولا يَتيَمَّم مَعَه؛ لأنه لم يَفعَله إلا لِحَال الضَّرورَة، والأمر المُختَلَف فيه أَحَبُّ إليَّ من التَّيمُّم.

وأما من قال: يَتيَمَّم مَعَه؛ فإنه خَطَأٌ بيِّن؛ لأن سُؤر الحِمار والبَغل والسِّباع وإن كان نَجِسًا، فتوضَّأت بِه؛ زَادَتْ مَواضِعُ وضوئك نَجَاسَةً، وقد زَاد، التَّيَمُّم لا يُطَهِّر النَّجاسات؛ أن التَّيَمُّم طهارةٌ بَدل الماء، فإن كُنت توضَّأت ثم تَيمَّمت بسُؤر ⦗١٠٩⦘ الحِمار؛ فقد أَذهَبت تَيَمُّمَك بالماء والقَذَرَ عنك، فمن هاهُنا كَرِهنا أن يَجمَعَهُما. والذي نَختَار من ذلك: أن يتوضَّأ بِه».
