I said: "What if he touches it with one or two fingers?" He said: "If he touches it, let him perform wudu'."
• I asked Ishaq, I said: "A man touched his penis, then prayed without performing wudu'?" He said: "He should repeat [it]."
• He said: And I heard Ishaq—another time—saying: "Whenever he touches his penis and there is no garment between his hand and the penis, he should repeat the wudu', whether in prayer or otherwise; because of what is authentically reported from the Prophet (peace be upon him) that whoever touches his penis should repeat the wudu'."
"If the penis touches the forearm or the hand, Malik and his companions held the view that wudu' is obligatory in that case, and they drew an analogy to the hand if it touches the penis. They said: The hand is among the places of wudu', and whenever it touches the penis, it is one of the places of wudu'; therefore, he must perform wudu'. This is a mistake."
Abu Ya'qub said: "This is merely a matter of acts of worship (ta'abbud) and submission; so whenever he touches [it]—as he mentioned—he should perform wudu'. And that does not occur except by gripping it with the hand; only then is it said: 'So-and-so touched his penis.'"
(1) Thus it is in the original, and only the ta' was undotted, with a fatha (vowel) on it, and the last letter was also vowelized; perhaps the correct word is "tusibuhu" (it touches it).
(2) Thus it is in the original, and the comparison of this to the hand touching the penis will follow; therefore, perhaps the term is a corruption of "al-sa'id" (the forearm), or the intended meaning is the back of the palm. See: Al-Awsat (1/207), Al-Tamhid (17/202-203), Al-Istidhkar (3/35).
