Chapter: Wudu' due to Backbiting (Ghibah)
• I asked Ishaq ibn Ibrahim regarding wudu' after backbiting. He said: "If he repeats [his wudu'], it is more beloved to me, but the obligation of repeating it is not clear."
235 - Muhammad ibn Abi Bakr narrated to us, saying: al-Muthanna ibn Bakr al-'Abdi narrated to us, saying: 'Abbad ibn Mansur narrated to us, from 'Ikrimah, from Ibn 'Abbas, that two men prayed the Dhuhr or 'Asr prayer with the Prophet (peace and blessings of Allah be upon him), and they were both fasting. When he finished the prayer, he said: "Repeat your wudu' and your prayer, continue your fast, and make it up on another day." They asked: "Why, O Messenger of Allah?" He said: "You both backbit so-and-so."
Chapter: Intention (Niyyah) in Wudu'
• It was said to Ahmad ibn Hanbal: A person in a state of janabah (major ritual impurity) cools himself with water, without intending by it to perform ghusl (ritual bath) for janabah? He said: "It does not suffice him." It was asked: "Is the same true for wudu' if he is teaching it to a man?" He said: "Yes, it does not suffice him, and likewise for tayammum (dry ablution). Indeed, deeds are only by intention." He relied upon the hadith of 'Umar ibn al-Khattab (may Allah be pleased with him), from the Prophet (peace and blessings of Allah be upon him): "Indeed, deeds are only by intention."
236 - Muhammad ibn Yahya ibn Abi Hazm narrated to us, saying: Muhammad ibn [Abi] Bakr narrated to us, saying: Hisham ibn Hassan narrated to us, from al-Hasan—regarding the one who immerses himself in a river while in a state of janabah; he said: "It has sufficed him for his ghusl and his wudu'."
(1) Thus it is in the original, and Harb has narrated repeatedly from Ibn Abi Hazm from "Muhammad ibn Bakr", who is al-Bursani, and this is the correct version.
باب: الوضوء من الغِيبَة
• سألت إسحاق بن إبراهيم عن الوضوء من الغِيبَة؟ قال: «إن أَعَاد فهو أَحَبُّ إليَّ، ولا يَتبَيَّن إيجابُ الإعادَة».
٢٣٥ - حدثنا محمد بن أبي بكر، قال: ثنا المثنى بن بكر العبدي، قال: ثنا عباد بن مَنصور، عن عِكرِمَة، عن ابن عَبَّاس، أن رجلَين صَلَّيا مع النبي صلى الله عليه وسلم صلاة الظهر أو العصر، وكانا صائمَين، فلما قَضَى الصَّلاة قال: «أَعِيدَا وضوءَكُما وصلاتَكُما، وامضيا في صَومِكُما، واقضِيَاهُ يَومًا آخَر». قالا: لِمَ يا رسول الله؟ قال: «اغتَبتُما فلانًا».
باب: النِّيَّة في الوضوء
• قيل لأحمَد بن حَنبل: الجُنُب يتَبَرَّد بالماء، لا يَنوي به الاغتِسالَ من الجَنابَة؟ قال: «لا يُجزئه». قيل: وكذلك الوضوء إذا عَلَّمَه رجلًا؟ قال: «نعم لا يُجزِئه، وكذلك التيمم، إنما الأعمال بالنِّيَّة»، وذَهَب إلى حديث عُمَر بن الخطاب -رضي الله عنه-، عن النبي -صَلَّى الله عليه وسلم-: «إنما الأعمال بالنِّيَّة».
٢٣٦ - حدثنا محمد بن يَحيى بن أبي حَزم، قال: ثنا محمد بن [أبي] (١) بكر، قال: ثنا هِشام بن حَسَّان، عن الحسَن -في الذي يَغتَمِس في النَّهر وهو جُنُب-؛ قال: «قد ⦗١٥٣⦘ أَجزَأ عَنه لِغُسله ولِوضوئه».
(١) كذا في الأصل، وقد روى حرب مرارا عن ابن أبي حزم عن "محمد بن بكر"، وهو البرساني، وهذا الصواب.
