in Islam, the Sacred Precinct (Haram) does not prevent the [administration of a] legal punishment (Hadd); whoever incurs a legal punishment, it shall be carried out upon him. "And to God is due from the people the pilgrimage to the House" (3:97). Muhammad said: Pilgrimage (Hajj) in the language means: "The intention/heading towards; it is said: I performed Hajj to a thing, I head towards it by performing Hajj; meaning, when I intend it time after time. From this is the saying of the poet:
(And I witness many from the tribe of 'Awf residing... they frequently visit the striped garment of al-Zibriqan, the saffron-dyed one)
Meaning: They frequently frequent him due to his eminence, and the leader used to wear a yellow turban which was a sign of his leadership.
His saying: "Whoever can find thereto a way" (3:97).
Yahya [narrated] from al-Hasan ibn Dinar, from al-Hasan, that a man said: O Messenger of God, [God has said]: "Whoever can find thereto a way." What is the way? He replied: Provision and a mount (transportation).
