"Then call to witness two men of justice from among you." Muhammad said: "The testimony between you" is in the nominative case (marfu') by way of the subject (mubtada') and the predicate (khabar) is "two men" (ithnan). The meaning is: The testimony of this situation is the testimony of two men.
Al-Hasan said: It means: from the Muslims of the kin, because the kin are more knowledgeable of the man, his children, and his wealth, and more likely not to forget what they testify to. If there is no one from the kin, then two others from outside the kin "if you are traveling through the land and the affliction of death befalls you." If they testify and they are both of justice, their testimony is accepted. If there is doubt regarding their testimony, they shall be detained after the afternoon prayer. In it, there is a rearrangement: "You detain them after the prayer" [the afternoon prayer] if you are suspicious. Al-Hasan said: If they were not from the people of [the prayer], they would not have sworn after the prayer: "They shall both swear by Allah if you are in doubt, 'We will not sell it for a price, even if he be a near relative, and we will not withhold the testimony of Allah; indeed, we would then be among the sinful.'"
Then their testimony is accepted.
فَأَشْهِدُوا ذَوَيْ عدلٍ مِنْكُمْ.
قَالَ مُحَمَّد: ﴿شَهَادَة بَيْنكُم﴾ رفع بِالِابْتِدَاءِ وَالْخَبَر ﴿اثْنَان﴾ الْمَعْنَى: شَهَادَةُ هَذِهِ الْحَالِ شَهَادَةُ اثْنَيْنِ.
قَالَ الْحَسَنُ: يَعْنِي:
مِنَ الْمُسْلِمِينَ مِنَ الْعَشِيرَةِ، لِأَنَّ الْعَشِيرَةَ أَعْلَمُ بِالرَّجُلِ وَبِوَلَدِهِ وَمَالِهِ، وَأَجْدَرُ أَلَّا يَنْسَوْا مَا يَشْهَدُونَ عَلَيْهِ، فَإِنْ لَمْ يَكُنْ مِنَ الْعَشِيرَةِ أحدٌ فَآخَرَانِ مِنْ غَيْرِ الْعَشِيرَةِ ﴿إِنْ أَنْتُمْ ضَرَبْتُمْ فِي الأَرْضِ فأصابتكم مُصِيبَة الْمَوْت﴾ فَإِنْ شَهِدَا وَهُمَا عَدْلَانِ مَضَتْ شَهَادَتُهُمَا وَإِنِ ارْتِيبَ فِي شَهَادَتِهِمَا حُبِسَا بَعْدَ صَلَاةِ الْعَصْرِ، وَفِيهَا تَقْدِيم ﴿تحبونهما من بعد الصَّلَاة﴾ [صَلَاةِ الْعَصْرِ] إِنِ ارْتَبْتُمْ. قَالَ الْحَسَنُ: وَلَوْ كَانَا مِنْ غَيْرِ أَهْلِ [الصَّلَاةِ] مَا حَلَفَا دُبُرَ الصَّلاةِ ﴿فَيُقْسِمَانِ بِاللَّهِ إِنِ ارْتَبْتُمْ لَا نَشْتَرِي بِهِ ثَمَنًا وَلَوْ كَانَ ذَا قُرْبَى وَلا نَكْتُمُ شَهَادَةَ اللَّهِ إِنَّا إِذًا لَمِنَ الآثمين﴾.
