al-Zuhri, ‘Urwah narrated to me, from ‘A’ishah, from the Prophet (peace and blessings of Allah be upon him) that he said: "It shall be returned from the charity of the one who deviates in his lifetime, just as what is returned from the will of the one who deviates at the time of his death."
My father said: Al-Walid ibn Mazid erred in this hadith, and this statement is from ‘Urwah only. Al-Walid ibn Muslim has reported this hadith from al-Awza’i, and he did not exceed ‘Urwah with it.
1619 - My father narrated to us, Abu Salih, the scribe of al-Layth, narrated to us, Mu’awiyah ibn Salih narrated to me, from ‘Ali ibn Abi Talhah, from Ibn ‘Abbas, regarding His saying: "Then reconcile between them"—he says: If the deceased makes an error in his will or fears in it, then there is no blame upon the guardians to return his error to what is correct.
It was reported from Abu al-‘Aliyah, Tawus, al-Hasan, Ibrahim, Sa’id ibn Jubayr, Qatadah, al-Rabi’ ibn Anas, and Muqatil ibn Hayyan something similar to that.
His saying: "So there is no sin upon him"
1620 - Muhammad ibn ‘Ammar ibn al-Harith narrated to us, ‘Abd al-Rahman ibn ‘Abd Allah al-Dashtaki narrated to us, Abu Ja’far al-Razi informed us, from al-Rabi’ ibn Anas, regarding His saying: "Then reconcile between them, so there is no sin upon him"—he says: The executor returns it to the truth after his [the testator's] death, so there is no sin upon him.
It was reported from Sa’id ibn Jubayr, ‘Ata’ ibn Abi Rabah, and Muqatil ibn Hayyan something similar to that.
His saying: "Indeed, Allah is Forgiving, Merciful"
1621 - Abu Zur’ah narrated to us, Yahya ibn ‘Abd Allah ibn Bukayr narrated to us, Ibn Lahi’ah narrated to me, ‘Ata’ ibn Dinar narrated to me, from Sa’id ibn Jubayr, regarding the saying of Allah: "Indeed, Allah is Forgiving, Merciful"—meaning: The executor, when he reconciled between the heirs; Merciful—meaning: Merciful to him, Acquainted with him, in that He granted him a concession to go against the biased will of the deceased.
His saying: "O you who have believed."
Its explanation has already preceded in verse 104.
His saying: "It has been prescribed for you"
And through the same chain from Sa’id ibn Jubayr regarding the saying of Allah: "It has been prescribed for you"—meaning: It has been made obligatory upon you.
His saying: "Fasting has been prescribed for you as it was prescribed for those before you"
The reports differ regarding that in three aspects:
الزُّهْرِيُّ، حَدَّثَنِي عُرْوَةُ، عَنْ عَائِشَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: يُرَدُّ مِنْ صَدَقَةِ الْحَائِفِ فِي حَيَاتِهِ، مَا يُرَدُّ مِنْ وَصِيَّةِ الْمُجْنِفِ عِنْدَ مَوْتِهِ.
قَالَ أَبِي: أَخْطَأَ الْوَلِيدُ بْنُ مَزْيَدٍ فِي هَذَا الْحَدِيثِ، وَهَذَا الْكَلامُ عَنْ عُرْوَةَ فَقَطْ. وَقَدْ رَوَى هَذَا الْحَدِيثَ: الْوَلِيدُ بْنُ مُسْلِمٍ عَنِ الأَوْزَاعِيِّ، وَلَمْ يُجَاوِزْ بِهِ عُرْوَةَ.
١٦١٩ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ كَاتِبُ اللَّيْثِ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، قَوْلُهُ: فَأَصْلَحَ بَيْنَهُمْ يَقُولُ: إِذَا أَخْطَأَ الْمَيِّتُ فِي وَصِيَّتِهِ أَوْ خَافَ فِيهَا، فَلَيْسَ عَلَى الأَوْلِيَاءِ حَرَجٌ أَنْ يَرُدُّوا خَطَأَهُ إِلَى الصَّوَابِ.
وَرُوِيَ عَنْ أَبِي الْعَالِيَةِ وَطَاوُسٍ وَالْحَسَنِ وَإِبْرَاهِيمَ وَسَعِيدِ بْنِ جُبَيْرٍ وَقَتَادَةَ وَالرَّبِيعِ بْنِ أَنَسٍ وَمُقَاتِلِ بْنِ حَيَّانَ، نَحْوُ ذَلِكَ.
قَوْلُهُ: فَلا إِثْمَ عَلَيْهِ
١٦٢٠ - حَدَّثَنَا مُحَمَّدُ بْنُ عَمَّارِ بْنِ الْحَارِثِ، ثنا عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ الدَّشْتَكِيُّ، أَنْبَأَ أَبُو جَعْفَرٍ الرَّازِيُّ، عَنِ الرَّبِيعِ بْنِ أَنَسٍ، فِي قَوْلِهِ: فَأَصْلَحَ بَيْنَهُمْ فَلا إِثْمَ عَلَيْهِ يَقُولُ: رَدَّهُ الْوَصِيُّ إِلَى الْحَقِّ بَعْدَ مَوْتِهِ فَلا إِثْمَ عَلَيْهِ.
وَرُوِيَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ وَعَطَاءِ بْنِ أَبِي رَبَاحٍ وَمُقَاتِلِ بْنِ حَيَّانَ، نَحْوُ ذَلِكَ.
قَوْلُهُ: إِنَّ اللَّهَ غَفُورٌ رَحِيمٌ
١٦٢١ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي قَوْلِ اللَّهِ: إِنَّ اللَّهَ غَفُورٌ رَحِيمٌ يَعْنِي: الْوَصِيَّ حِينَ أَصْلَحَ بَيْنَ الْوَرَثَةِ رَحِيمٌ يَعْنِي: رَحِيمًا بِهِ خَبِيرًا بِهِ، حَيْثُ رَخَّصَ لَهُ فِي خِلَافِ جَوْرِ وَصِيَّةِ الْمَيِّتِ.
قَوْلُهُ: يا أيها الذين آمنوا.

قوله: كُتِبَ عَلَيْكُمْ
وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ: كُتِبَ عَلَيْكُمْ يَعْنِي: فُرِضَ عَلَيْكُمْ.
قَوْلُهُ: كُتِبَ عَلَيْكُمُ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِنْ قَبْلِكُمْ
