the man. A man marries a woman, then divorces her before he touches [has intercourse with] her. If he divorces her once, she is separated from him; there is no waiting period (iddah) for her; she may marry whom she wishes. Then He said: "Provide for them and release them in a graceful manner." He says: If he had specified a dowry for her, she has only half of it. If he had not specified a dowry for her, he should provide for her according to his capacity, whether he is well-off or in difficulty, and this is the "graceful manner." (1)
- From Ibn Abbas, may God be pleased with them both, that he recited: "O you who have believed, when you marry the believing women and then divorce them before you have touched them," and said: There is no divorce until there has been a marriage. (2)
- Through the path of Sa'id ibn Jubayr, from Ibn Abbas, may God be pleased with them both, that he said: If a man says, "Every woman I marry is divorced," or "If I marry so-and-so, she is divorced," then it is of no effect. Divorce only applies to one whom he possesses, because God says: "When you marry the believing women and then divorce them." (3)
- Ahmad ibn Mansur al-Marwazi narrated to us, al-Nadr ibn Shumayl narrated to us, Yunus, meaning Ibn Abi Ishaq, narrated to us, [who said]: I heard Adam, the mawla (freedman) of Khalid, from Sa'id ibn Jubayr, from Ibn Abbas who said: If a man says, "Every woman I marry is divorced," he said: It is of no effect, because God the Almighty says: "O you who have believed, when you marry the believing women and then divorce them..." the verse. The saying of the Almighty: O Prophet, indeed We have made lawful for you your wives
- From Umm Hani bint Abi Talib, may God be pleased with her, who said: The Messenger of God (peace be upon him) proposed to me, but I apologized to him and he accepted my excuse. Then God revealed: "O Prophet, indeed We have made lawful for you your wives" up to His saying: "...who have emigrated with you." She said: So I was not lawful for him because I did not emigrate with him; I was among those set free (al-tulaqa). (5)
- From Mujahid, may God be pleased with him, regarding His saying: "Indeed We have made lawful for you your wives," he said: His first wives who were with him before this verse was revealed. Regarding His saying: "...those to whom you have given their dowries," he said: Their dowries. And regarding "...that which your right hand possesses," he said: They are the slave-women whom God has designated for him as spoils of war. (6)
