1702: 9082: Thing: 1: Ibn Kathir said in the interpretation of this verse: The Exalted explains the detail of what He legislated specifically for this noble nation among all the preceding nations, by making the spoils of war permissible. Al-Ghanimah (spoils of war) is the wealth taken from the disbelievers through the charging of horses and riding beasts. Al-Fay' (spoils taken without fighting) is what is taken from them other than that, such as wealth they agree to reconcile upon, or which they leave behind without any heirs, as well as the Jizyah (poll tax), Kharaj (land tax), and the like. This is the school of Imam al-Shafi'i among a group of the predecessors and successors. Among the scholars, there are those who apply the term 'Al-Fay'' to that which is also applied to 'Al-Ghanimah,' and vice versa.

Abu al-Darda' said to 'Ubadah: 'O 'Ubadah, [what about] the words of the Messenger of Allah (peace and blessings of Allah be upon him) in such and such a military campaign regarding the fifths?' 'Ubadah said: 'The Messenger of Allah (peace and blessings of Allah be upon him) prayed with them in a campaign, [holding] a hair from the spoils. When he finished the prayer, the Messenger of Allah (peace and blessings of Allah be upon him) stood up with the hair between his fingertips and said: "This is part of your spoils; I have no share in it except my portion with you, which is the fifth, and the fifth is returned to you. So, return even the thread and the needle [if taken from the spoils], and even things smaller or larger than that. Do not commit Ghulul (stealing from the spoils), for Ghulul is a disgrace and a fire for those who commit it in this world and the hereafter. Strive against the people for the sake of Allah, the near and the far, and do not fear for the sake of Allah the blame of any critic. Establish the limits (hudud) of Allah in travel and at home, for Jihad is a great door among the doors of Paradise, through which Allah saves one from worry and distress."
