2154: 11675: From what you fortify: 1: Al-Qurtubi said in the interpretation of this verse: Meaning: Extract what you need according to the extent of the need. This verse is a foundational principle for advocating the Shar'i interests (al-masalih al-shar'iyyah), which are the preservation of religion, lives, intellect, lineage, and property. Thus, everything that ensures the attainment of any of these matters is an interest (maslahah), and everything that causes the loss of any of them is a corruption (mafsadah), and repelling it is an interest. There is no disagreement that the purpose of the laws is to guide people to their worldly interests so that they may attain the ability to know Allah—the Exalted—and to worship Him, both of which lead to eternal happiness in the Hereafter. Observing this is a grace and mercy from Allah, the Mighty and Majestic, with which He has favored His servants, without it being an obligation upon Him or a [pre-existing] entitlement. This is the doctrine of all the verifiers (al-muhaqqiqin) among all the Sunnis, and it is elaborated upon in the Principles of Jurisprudence (Usul al-Fiqh).

2156: 11685: The excuse: 1: Narrated by Ahmad (2/346, 389), al-Manthur (4/23), al-Kanz (32415), Ibn Kathir (4/319), and al-Majma' (7/40), and he attributed it to Ahmad; it contains Muhammad ibn 'Amr, and he is a fair narrator (hasan al-hadith).

: 11686: Upon them: 2: Tafsir Ibn Kathir: (2/481). Ibn Kathir said: "This is a mursal (dispatched) hadith."

2157: 11695: The treacherous: 1: Al-Qurtubi said: There is disagreement regarding who said it. It is said: It is a statement by the wife of al-'Aziz, and it is connected to her saying: "Now the truth has become clear" (al-an hashasa al-haqq), meaning: I have admitted the truth so that it may be known that I did not betray him by lying about him, nor did I mention him with evil while he was absent; rather, I told the truth and spoke of the treachery. Then she said: "And I do not acquit myself," but rather, I sought to seduce him. According to this, she was acknowledging the Creator, which is why she said: "Indeed, my Lord is Forgiving, Merciful."

استخرجوا ما تحتاجون إليه بقدر الحاجة، وهذه الآية أصل في القول بالمصالح الشرعية التي هي حفظ الأديان والنفوس والعقول والأنساب والأموال فكل ما تضمن تحصيل شيء من هذه الأمور فهو مصلحة، وكل ما يفوته شيء منها فهو مفسدة، ودفعه مصلحة ولا خلاف أن مقصود الشرائع إرشاد الناس إلى مصالحهم الدنيوية، ليحصل لهم التمكن من معرفة الله- تعالى- وعبادته الموصلتين إلى السعادة الأخروية، ومراعاة ذلك فضل من الله عز وجل ورحمة رحم بها عباده، ومن غير وجوب عليه، ولا استحقاق هذا مذهب كافة المحققين من أهل السنة أجمعين، وبسطه في أصول الفقه.
