His saying (Exalted is He): "Provision for a year without turning them out"

2391 - My father narrated to me, Abu Salih reported to us, Mu'awiyah b. Salih narrated to me, from 'Ali b. Abi Talhah, from Ibn 'Abbas, regarding His saying: "And those who are taken in death among you and leave wives behind, [there shall be] a bequest for their wives, provision for a year without turning them out." He said: If a man died and left his wife behind, she would observe the 'iddah (waiting period) for a year in his house, and he would provide for her from his wealth. Then Allah revealed after that: "And those who are taken in death among you and leave wives behind, they [the wives] shall wait for themselves four months and ten days." This is the 'iddah of the woman whose husband has died, unless she is pregnant, in which case her 'iddah is until she delivers what is in her womb. And He said: "And for them is one-fourth of what you leave if you have no child, but if you have a child, then for them is one-eighth." Thus Allah clarified the inheritance of the woman and discontinued the bequest and the maintenance.

It was narrated from Mujahid, al-Hasan, 'Ikrimah, Qatadah, al-Dahhak, al-Rabi' b. Anas, and Muqatil b. Hayyan that they said: The verse of "four months and ten days" abrogated it.

It was narrated from Sa'id b. al-Musayyib that he said: The verse in Surah al-Ahzab abrogated it: "O you who have believed, when you marry believing women..."

His saying (Exalted is He): "Without turning them out"

2392 - Hajjaj b. Hamzah narrated to us, Shababah reported to us, Warqa' reported to us, from Ibn Najih, he said: 'Ata' said, from Ibn 'Abbas: This verse has been abrogated; her 'iddah is among his people, and she may observe it wherever she wishes, and this is the statement of Allah: "Without turning them out."

2393 - Usayd b. 'Asim narrated to us, Sa'id b. 'Amir reported to us, from Hammam, from Qatadah regarding "without turning them out," he said: When a woman's husband died, she had the right to housing and maintenance for a year from her husband's wealth, as long as she did not leave. Then that was abrogated thereafter, and a known portion was assigned to her.

His saying: "Then if they leave"

2394 - Hajjaj b. Hamzah narrated to us, Shababah reported to us, Warqa' reported to us, from Ibn Abi Najih, from Mujahid, he said: Allah says: "And those who are taken in death among you and leave wives behind, [there shall be] a bequest for their wives, provision for a year without turning them out; then if they leave, there is no sin upon you for what they do with themselves."

٢٣٩١ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، فِي قَوْلِهِ: وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا وَصِيَّةً لِأَزْوَاجِهِمْ مَتَاعًا إِلَى الْحَوْلِ غَيْرَ إِخْرَاجٍ فَكَانَ الرَّجُلُ إِذَا مَاتَ وَتَرَكَ امْرَأَتَهُ، اعْتَدَّتْ سَنَةً فِي بَيْتِهِ، يُنْفِقُ عَلَيْهَا مِنْ مَالِهِ، ثُمَّ أَنْزَلَ اللَّهُ بَعْدُ وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا «١» فَهَذِهِ عِدَّةُ الْمُتَوَفَّى عَنْهَا إِلا أَنْ تَكُونَ حَامِلا، فَعِدَّتُهَا أَنْ تَضَعَ مَا فِي بَطْنِهَا وَقَالَ: وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ إِنْ لَمْ يَكُنْ لَكُمْ وَلَدٌ فَإِنْ كَانَ لَكُمْ وَلَدٌ فَلَهُنَّ الثَّمَنُ فَبَيَّنَ اللَّهُ مِيرَاثَ الْمَرْأَةِ وَتَرَكَ الْوَصِيَّةَ وَالنَّفَقَةَ

وَرُوِيَ عَنْ مُجَاهِدٍ وَالْحَسَنِ وَعِكْرِمَةَ وَقَتَادَةَ «٢» وَالضَّحَّاكِ وَالرَّبِيعِ بْنِ أَنَسٍ وَمُقَاتِلِ بْنِ حَيَّانَ قَالُوا: نَسَخَتْهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا

وَرُوِيَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ:

نَسَخَتْهَا الآيَةُ الَّتِي فِي الأَحْزَابِ يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ «٣»

قوله تَعَالَى: غَيْرَ إِخْرَاجٍ

٢٣٩٢ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا ورقاء عن ابن نَجِيحٍ، قَالَ: قَالَ عَطَاءٌ: عَنِ ابْنِ عَبَّاسٍ: نَسَخَتْ هَذِهِ الآيَةَ، عِدَّتُهَا فِي أَهْلِهِ تَعْتَدُّ حَيْثُ شَاءَتْ وَهُوَ قَوْلُ اللَّهِ غَيْرَ إِخْرَاجٍ «٤»

٢٣٩٣ - حَدَّثَنَا أُسَيْدُ بْنُ عَاصِمٍ، ثنا سَعِيدُ بْنُ عَامِرٍ، عَنْ هَمَّامٍ، عَنْ قَتَادَةَ غَيْرَ إِخْرَاجٍ قَالَ: كَانَتِ الْمَرْأَةُ إِذَا تُوِفَّيَ عَنْهَا زَوْجُهَا، كَانَ لَهَا السُّكْنَى وَالنَّفَقَةُ حَوْلا مِنْ مَالِ زَوْجِهَا، مَا لَمْ تَخْرُجْ، ثُمَّ نُسِخَ بَعْدَ ذَلِكَ فَجُعِلَ لَهَا فَرِيضَةٌ مَعْلُومَةٌ.

قَوْلُهُ: فَإِنْ خَرَجْنَ

٢٣٩٤ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا وَرْقَاءُ، عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ، قَالَ اللَّهُ: وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا وَصِيَّةً لِأَزْوَاجِهِمْ مَتَاعًا إِلَى الْحَوْلِ غَيْرَ إِخْرَاجٍ فَإِنْ خَرَجْنَ فَلَا جُنَاحَ عَلَيْكُمْ فِي مَا فَعَلْنَ فِي أنفسهن جعل الله لها
