Translation · EN

before he has touched her, and he has not specified a dowry for her, so Allah commanded that he provide for her according to his capacity, whether he be well-off or poor. As for her for whom he has specified a dowry, she is entitled to half of the dowry.

[The Second Aspect]

2400 - The Ahmasi narrated to us, Waki' reported to us, from Shu'bah, from Qatadah, from Sa'id b. al-Musayyib, he said: This verse was abrogated by the one that follows it: "And if you divorce them before you have touched them and you have already specified for them a dowry, then [give them] half of what you specified," [it] abrogated "And for the divorced women is provision in an honorable manner."

2401 - My father narrated to me, Ibn Nufayl reported to us, 'Attab b. Khusayf reported to us, regarding His saying: "And for the divorced women is provision in an honorable manner," he said: That was before the [inheritance] obligations.

[The Third Aspect]

2402 - My father narrated to me, Ahmad b. 'Abd al-Rahman al-Dashtaki reported to us, 'Abd Allah b. Abi Ja'far reported to us, from his father, from al-Rabi', regarding His saying: "And for the divorced women is provision in an honorable manner," he said: Abu al-'Aliyah said: For every divorced woman there is a provision (mut'ah), whether he has consummated the marriage with her or has not consummated it with her.

It was narrated from 'Ata' and al-Zuhri that they both said: For every divorced woman there is a provision.

2403 - The Ahmasi narrated to us, Waki' reported to us, from Hasan b. Salih, from 'Abd al-A'la, from Shurayh, regarding "And for the divorced women is provision in an honorable manner," he said: A shirt (dir'), a head covering (khimar), an outer garment (jilbab), or a waist wrapper (mintaq).

His saying (Exalted is He): "A duty upon the righteous"

[The First Aspect]

2404 - My father narrated to me, Abu Salamah al-Minqari reported to us, Jarir b. Hazim reported to us, from Ya'la b. Hakim, he said: I heard a man ask Sa'id b. Jubayr about the provision (mut'ah): Is it incumbent upon everyone? He said: No. He said: Then upon whom? He said: Upon the righteous.

[The Second Aspect]

2405 - Usayd b. 'Asim narrated to us, Husayn b. Hafs reported to us, he said: Sufyan said: If he divorces her and has already consummated the marriage with her, and he has specified a dowry for her, then he is liable for the provision, and he is not to be forced to do so, but it is said to him: Provide [for her] if you are among the righteous, without him being compelled to do so.
