The Second Aspect:
3710 - My father narrated to us, 'Abd al-Rahman b. al-Dahhak narrated to us, Suwayd—meaning Ibn 'Abd al-'Aziz—narrated to us, 'Abd al-Malik b. al-Nu'man narrated to us, he said: I heard Numayr b. Aws saying regarding "as long as you are standing over him": It means the evidence.
His saying, the Exalted: "That is because they said, 'There is no blame upon us concerning the unlearned.'"
[The First Aspect]
3711 - Ahmad b. Sinan narrated to us, 'Abd al-Rahman b. Mahdi narrated to us, Sufyan al-Thawri narrated to us, from Abu Ishaq, from Sa'sa'ah b. Yazid, he said: I asked Ibn 'Abbas, saying: We travel in the land of the dhimmah [protected] people and we take from them [goods] without payment. He said: What do you say? We say: There is no harm in that. He said: You are saying as the People of the Scripture said: "There is no blame upon us concerning the unlearned," and they speak falsehood about Allah while they know.
3712 - Muhammad b. Yahya narrated to us, Abu al-Rabi' al-Zahrani informed us, Ya'qub narrated to us, Ja'far informed us, from Sa'id b. Jubayr, he said: When the People of the Scripture said: "That is because they said, 'There is no blame upon us concerning the unlearned,'" the Prophet of Allah said: The enemies of Allah have lied. Everything that was in the Jahiliyyah [Age of Ignorance] is beneath these two feet of mine, except for the trust (amanah), for it must be rendered to the righteous and the wicked alike.
3713 - Ahmad b. 'Uthman b. Hakim al-Awdi narrated to us, Ahmad b. al-Mufaddal narrated to us, Asbat narrated to us, from al-Suddi regarding "That is because they said, 'There is no blame upon us concerning the unlearned,'" he said: The believer says to him, "Why do you not fulfill your trust?" and he replies, "There is no sin upon us regarding the wealth of the Arabs; Allah has made it lawful for us."
Abu Muhammad said: It was narrated from al-Rabi' b. Anas that he said: The Jews said: There is no blame upon us regarding what we obtain of the Arabs' wealth.
3714 - 'Ali b. al-Mubarak reported to me in what he wrote to me, Zayd b. al-Mubarak narrated to us, Ibn Thawr narrated to us, from Ibn Jurayj regarding His saying: "There is no blame upon us concerning the unlearned," he said: Some people among the Muslims traded with them in the Jahiliyyah, and they [the Jews] said: There is no trust upon us, and there is no settlement [of debt] for you upon us because you abandoned your religion that you were following, and they claimed that in their Book. He said: "And they speak falsehood about Allah while they know."

٣٧١٠ - حَدَّثَنَا أَبِي، ثنا عَبْدُ الرَّحْمَنِ بْنُ الضَّحَّاكِ، ثنا سُوَيْدٌ يَعْنِي: ابْنَ عَبْدِ الْعَزِيزِ، ثنا عَبْدُ الْمَلِكِ بْنُ النُّعْمَانِ قَالَ: سَمِعْتُ نُمَيْرَ بْنَ أَوْسٍ يَقُولُ إِلا مَا دُمْتَ عَلَيْهِ قَالَ: الْبَيِّنَةُ.
قَولُهُ تَعَالَى: ذَلِكَ بِأَنَّهُمْ قَالُوا ليس علينا في الأميين سبيل

٣٧١١ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ، ثنا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، ثنا سُفْيَانُ الثَّوْرِيُّ، عَنْ أَبِي إِسْحَاقَ، عَنْ صَعْصَعَةَ بْنِ يَزِيدَ قَالَ سَأَلْتُ ابْنَ عَبَّاسٍ قُلْتُ: إِنَّا نَسِيرُ فِي أَرْضِ أَهْلِ الذِّمَّةِ فَنُصِيبُ مِنْهُمْ بِغَيْرِ ثَمَنٍ قَالَ: فَمَا تَقُولُونَ؟ نَقُولُ لَا بَأْسَ بِهِ. قَالَ: أَنْتُمْ تَقُولُونَ كَمَا قَالَ أَهْلُ الْكِتَابِ: لَيْسَ عَلَيْنَا فِي الْأُمِّيِّينَ سَبِيلٌ وَيَقُولُونَ عَلَى اللَّهِ الْكَذِبَ وَهُمْ يَعْلَمُونَ
٣٧١٢ - حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، أَنْبَأَ أَبُو الرَّبِيعِ الزَّهْرَانِيُّ، ثنا يَعْقُوبُ أَنْبَأَ جَعْفَرٌ، عَنِ سَعِيدِ بْنِ جُبَيْرٍ قَالَ: لَمَّا قَالَ أَهْلُ الْكِتَابِ: ذَلِكَ بِأَنَّهُمْ قَالُوا لَيْسَ عَلَيْنَا فِي الْأُمِّيِّينَ سَبِيلٌ قَالَ نَبِيُّ اللَّهِ: كَذَبَ أَعْدَاءُ اللَّهِ مَا مِنْ شَيْءٍ كَانَ فِي الْجَاهِلِيَّةِ إِلا وَهُوَ تَحْتَ قَدَمَيَّ هَاتَيْنِ، إِلا الأَمَانَةَ فَإِنَّهَا مُؤَدَّاةٌ إِلَى الْبَرِّ وَالْفَاجِرِ.
٣٧١٣ - حَدَّثَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ الأَوْدِيُّ، ثنا أَحْمَدُ بْنُ مُفَضَّلٍ، ثنا أَسْبَاطٌ، عَنِ السُّدِّيِّ ذَلِكَ بِأَنَّهُمْ قَالُوا ليس علينا في الأميين سبيل قَالَ: فَيَقُولُ لَهُ الْمُؤْمِنُ مَا بَالُكَ لَا تُؤَدِّي أَمَانَتَكَ؟ فَيَقُولُ: لَيْسَ عَلَيْنَا حَرَجٌ فِي أَمْوَالِ الْعَرَبِ سَبِيلٌ، قَدْ أَحَلَّهَا اللَّهُ لَنَا.
قَالَ أَبُو مُحَمَّدٍ: وَرُوِيَ عَنِ الرَّبِيعِ بْنِ أَنَسٍ قَالَ: قَالَتِ الْيَهُودُ: لَيْسَ عَلَيْنَا فِيمَا أَصَبْنَا مِنْ أَمْوَالِ الْعَرَبِ سَبِيلٌ.
٣٧١٤ - أَخْبَرَنَا عَلِيُّ بْنُ الْمُبَارَكِ فِيمَا كَتَبَ إِلَيَّ، ثنا زَيْدُ بْنُ الْمُبَارَكِ، ثنا ابْنُ ثَوْرٍ، عَنِ ابْنِ جَرِيحٍ فِي قَوْلِهِ: لَيْسَ عَلَيْنَا فِي الأُمِّيِّينَ سَبِيلٌ قَالَ: بَايَعَهُمْ نَاسٌ مِنَ الْمُسْلِمِينَ فِي الْجَاهِلِيَّةِ فَقَالُوا: لَيْسَ عَلَيْنَا أَمَانَةٌ، وَلا قَضَاءَ لَكُمْ عِنْدَنَا لأَنَّكُمْ تَرَكْتُمْ دِينَكُمُ الَّذِي كُنْتُمْ عَلَيْهِ، وا؟؟ دعوا ذلك في كتابكم قَالَ: وَيَقُولُونَ عَلَى اللَّهِ الْكَذِبَ وَهُمْ يَعْلَمُونَ.
