His saying, the Most High: "If you fear"

2220 - Musa b. Harun al-Tusi informed us in what he wrote to me, al-Husayn b. Muhammad al-Marrudhi narrated to us, Shayban narrated to us, from Qatadah regarding: "If you fear," meaning: the authorities.

His saying: "That they will not maintain the limits of Allah"

2221 - My father narrated to us, Abu Salih the scribe of al-Layth narrated to us, Mu'awiyah b. Salih narrated to me, from 'Ali b. Abi Talhah, from Ibn 'Abbas regarding: "If you fear that they will not maintain the limits of Allah, then there is no blame upon them in that with which she redeems herself," [this refers to] her abandoning the maintenance of the limits of Allah, out of disregard for the right of her husband and her bad character. She says to him: "By Allah, I will not fulfill an oath for you, nor will I step onto a sleeping place for you, nor will I obey an order for you." When she does that, the redemption (fidyah) has become lawful for him from her, and he should not take more than what he gave her, and he shall release her if the wrong was on her part.

2222 - Abu Sa'id al-Ashaj narrated to us, 'Uqbah narrated to us from Isra'il, from Jabir, from 'Amir regarding: "If you fear that they will not maintain the limits of Allah," he said: They will not obey Allah.

His saying: "Then there is no blame upon them in that with which she redeems herself"

[The first view]

2223 - My father narrated to us, Musa b. Isma'il narrated to us, Hammad b. Salamah narrated to us, from Humayd, from Raja' b. Haywah, from Qabisah b. Dhu'ayb, that he recited this verse: "Then there is no blame upon them in that with which she redeems herself." He said: If he wishes, he may take more than what he gave her.

2224 - Muhammad b. Isma'il al-Ahmasi narrated to us, Waki' narrated to us, from Yazid b. Ibrahim, from al-Hasan regarding: "Then there is no blame upon them in that with which she redeems herself," he said: That is regarding khul' (divorce by redemption), when she says: "By Allah, I will not perform the ritual bath (ghusl) from sexual impurity for you."

And the second view:

2225 - Muhammad b. 'Uzayz al-Ayli narrated to us, Salamah narrated to us, from 'Aqil, he said: And I asked Muhammad [al-Zuhri]: Is it proper for a man to accept from his wife as redemption (fidyah) in a khul', more than what he gave her? Or for her to return to him if they both agree, without him returning to her anything of what she had redeemed herself from him with? Muhammad—meaning al-Zuhri—said: I have not heard a sunnah regarding this, but we hold—and Allah knows best—that he should not take except what he gave her, for Allah, the Blessed and Exalted, said: "Then there is no blame upon them in that with which she redeems herself."
