4849 - Abu Zur'ah narrated to us, Yahya reported to us, Ibn Lahi'ah reported to us, 'Ata' narrated to me, from Sa'id regarding His saying: "prescribed" (mafrudan), meaning: determined. Abu Muhammad said: A similar statement is narrated from al-Dahhak.

His saying, the Almighty and Exalted: "And when those of kinship are present at the division"

4850 - Muhammad ibn Sa'd al-'Awfi informed me in what he wrote to me, my father narrated to me, my paternal uncle narrated to me, my father narrated to me, from his father, from Ibn 'Abbas regarding His saying: "And when those of kinship are present," meaning: at the time of the division of the inheritance. This was before the fixed shares (al-fara'id) were revealed. Then Allah the Almighty revealed the fixed shares thereafter, and gave every person who has a right their due right, and charity was made from what the deceased had designated.

Abu Muhammad said: It is narrated from al-Hasan, Sa'id ibn Jubayr, and Muqatil ibn Hayyan that they said: "At the time of the division of the inheritance."

4851 - Ahmad ibn 'Uthman ibn Hakim al-Awdi narrated to us, Ahmad ibn Mufaddal reported to us, Asbat reported to us, from al-Suddi regarding His saying: "And when those of kinship are present at the division, as well as the orphans and the needy," he said: This applies in three ways: First, the person may make a bequest to them, so they attend and receive their bequest. Second, they attend and partake [in the division] if they are men; thus, it is appropriate for them to give them something. Third, if the heirs are minors, their guardian stands when he divides [the estate] and says to those who have attended: "Your right is a right, and your kinship is close, and if I had a share in this inheritance, I would have given you [something]."

His saying, the Almighty: "those of kinship"

4852 - My father narrated to us, Abu Salih, the scribe of al-Layth, reported to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "And when those of kinship are present at the division," he said: Allah commanded the believers, at the time of dividing their inheritances, to uphold their ties of kinship.

4853 - My father narrated to us, al-Mu'alla ibn Rashid reported to us, 'Abd al-Wahid reported to us, 'Asim al-Ahwal reported to us, he said: Abu al-'Aliyah said regarding His saying: "And when those of kinship are present at the division," he said: This clarifies the matter for the heirs, that they should give a small portion at the time of the division of the inheritance to those of the relatives of the deceased who do not inherit. Abu Muhammad said: A similar statement is narrated from Muqatil ibn Hayyan.

His saying, the Almighty: "and the orphans"

4854 - My father narrated to us, Abu Salih reported to us, Mu'awiyah ibn Salih narrated to me, from 'Ali, from Ibn 'Abbas: "And when those of kinship are present at the division, as well as the orphans," he said: Allah commanded the believers, at the time of dividing their inheritances, to uphold their ties of kinship and to provide for their orphans from the bequest.
