4861 - Ahmad ibn 'Isam narrated to us, Abu 'Asim reported to us, Shu'bah reported to us, Qatadah reported to us, from Yunus ibn Jubayr, from Hittan, from Abu Musa, that he distributed [wealth] for him according to this verse: "And when those of kinship are present at the division."
4862 - Ahmad ibn Sinan narrated to us, 'Abd al-Rahman reported to us, from Sufyan, from Ibn Abi Najih, from Mujahid, regarding: "And when those of kinship are present at the division, as well as the orphans and the needy," he said: "It is an obligation upon the people of the inheritance as much as their souls are content with." Abu Muhammad said: A similar [view] was narrated from 'Abd al-Rahman ibn Abi Bakr, Abu al-'Aliyah, al-Hasan, Muhammad ibn Sirin, al-Sha'bi, Sa'id ibn Jubayr, Mujahid, Makhul, al-Zuhri, Ibrahim al-Nakha'i, 'Ata', and Yahya ibn Ya'mar.
[That it is regarding the bequest]
Those who interpreted that as referring to the bequest:
4863 - Al-Hasan ibn Abi al-Rabi' narrated to us, 'Abd al-Razzaq informed us, Ibn Jurayj informed us, Ibn Abi Mulaykah informed me that Asma' bint 'Abd al-Rahman ibn Abi Bakr and al-Qasim ibn Muhammad informed him that 'Abd Allah ibn 'Abd al-Rahman ibn Abi Bakr divided the inheritance of his father, 'Abd al-Rahman, while 'A'ishah was alive. They both said: He did not leave behind a needy person or a relative in the house without giving them from his father's inheritance. He said: And he recited: "And when those of kinship are present at the division." He said: The division. I mentioned that to Ibn 'Abbas, and he said: "He was not correct; that is not for him. That only pertains to the bequest, and this verse is only regarding the bequest," meaning that the deceased wishes to make a bequest to them.

4864 - Al-Hasan ibn Muhammad ibn al-Sabbah narrated to us, Hajjaj reported to us, from Ibn Jurayj, and 'Uthman ibn 'Ata', from 'Ata', from Ibn 'Abbas regarding his saying: "And when those of kinship are present at the division, as well as the orphans and the needy, so provide for them from it," [he said:] The verse of inheritance abrogated it, so He assigned for every person his share from what was left... from what was little of it or much. Abu Muhammad said: A similar [view] was narrated from Sa'id ibn al-Musayyib, 'Ikrimah, Abu al-Sha'tha', al-Qasim ibn Muhammad, al-Dahhak, Abu Salih, Abu Malik, 'Ata' al-Khurasani, Zayd ibn Aslam, Rabi'ah ibn Abi 'Abd al-Rahman, and Muqatil ibn Hayyan.

٤٨٦١ - حَدَّثَنَا أَحْمَدُ بْنُ عِصَامٍ، ثنا أَبُو عَاصِمٍ، ثنا شُعْبَةُ، ثنا قَتَادَةُ، عَنْ يُونُسَ بْنِ جُبَيْرٍ، عَنْ حِطَّانَ، عَنْ أَبِي مُوسَى أَنَّهُ قَسَمَ لَهُ بِهَذِهِ الآيَةِ وَإِذَا حَضَرَ الْقِسْمَةَ أولوا الْقُرْبَى «١» .
٤٨٦٢ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ، ثنا عَبْدُ الرَّحْمَنِ، عَنْ سُفْيَانَ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ وَإِذَا حَضَرَ الْقِسْمَةَ أُوْلُواْ الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ قَالَ: هِيَ وَاجِبَةٌ عَلَى أَهْلِ الْمِيرَاثِ مَا طَابَتْ بِهِ أَنْفُسُهُمْ «٢» - قَالَ أَبُو مُحَمَّدٍ: وَرُوِيَ عَنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ، وَأَبِي الْعَالِيَةِ، وَالْحَسَنِ، وَمُحَمَّدِ بْنِ سِيرِينَ، وَالشَّعْبِيِّ، وَسَعِيدِ بْنِ جُبَيْرٍ، وَمُجَاهِدٍ، وَمَكْحُولٍ، وَالزُّهْرِيِّ، وَإِبْرَاهِيمَ النَّخَعِيِّ، وَعَطَاءٍ، وَيَحْيَى بْنِ يَعْمَرَ نحو ذلك.

٤٨٦٣ - حَدَّثَنَا الْحَسَنُ بْنُ أَبِي الرَّبِيعِ، أَنْبَأَ عَبْدُ الرَّزَّاقِ، أَنْبَأَ ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ أَنَّ أَسْمَاءَ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ، وَالْقَاسِمَ بْنَ مُحَمَّدٍ أَخْبَرَاهُ أَنَّ عَبْدَ اللَّهِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ قَسَمَ مِيرَاثَ أَبِيهِ، عَبْدِ الرَّحْمَنِ، وَعَائِشَةُ حَيَّةٌ، قَالا: فَلَمْ يَدَعْ فِي الدَّارِ مِسْكِيناً وَلا ذَا قَرَابَةٍ إِلا أَعْطَاهُ مِنْ مِيرَاثِ أَبِيهِ قَالَ: وَتَلا:
وَإِذَا حَضَرَ القسمة أولوا الْقُرْبَى قَالَ: الْقِسْمَ، فَذَكَرْتُ ذَلِكَ لابْنِ عَبَّاسٍ، فَقَالَ:
مَا أَصَابَ، لَيْسَ ذَلِكَ لَهُ، إِنَّمَا ذَلِكَ إِلَى الْوَصِيَّةِ، وَإِنَّمَا هَذِهِ الآيَةُ فِي الْوَصِيَّةِ يريد الميت أن يوصي لهم.

٤٨٦٤ - حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ الصَّبَّاحِ، ثنا حَجَّاجٌ، عَنِ ابْنِ جُرَيْجٍ، وَعُثْمَانَ بْنِ عَطَاءٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَإِذَا حَضَرَ الْقِسْمَةَ أُوْلُواْ الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُم مِنْهُ نَسَخَتْهَا آيَةُ الْمِيرَاثِ، فَجَعَلَ لِكُلِّ إِنْسَانٍ نَصِيبَهُ مِمَّا تُرِكَ ... مِمَّا قَلَّ مِنْهُ أَوْ كَثُرَ- قَالَ أَبُو مُحَمَّدٍ: وَرُوِيَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَعِكْرِمَةَ، وَأَبِي الشَّعْثَاءِ، وَالْقَاسِمِ بْنِ مُحَمَّدٍ، وَالضَّحَّاكِ، وَأَبِي صَالِحٍ، وَأَبِي مَالِكٍ، وَعَطَاءٍ الْخُرَاسَانِيِّ، وَزَيْدِ بْنِ أَسْلَمَ، وَرَبِيعَةِ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، وَمُقَاتِلِ بْنِ حَيَّانَ نحو ذلك.
