4941 - Abu Zur'ah narrated to us, Yahya ibn Abdullah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to me, Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding the saying of God the Exalted: "If they are more than that," meaning: more than one, and they are two up to ten or more.
His saying, the Exalted: "Then they are partners in the third"
4942 - It was read to Yunus ibn Abd al-A'la, Abdullah ibn Wahb informed us, Yunus ibn Yazid informed me, from Ibn Shihab who said: Umar ibn al-Khattab judged that the inheritance of brothers from the mother is among them, for the male is like the female. He said: And I do not think Umar ibn al-Khattab judged that until he learned it from the Messenger of God, peace and blessings of God be upon him, and from this verse which God the Exalted said: "Then they are partners in the third." It was narrated from al-Hasan, Sa'id ibn Jubayr, and Qatadah similar to that.
His saying, the Exalted: "after any bequest you may bequeath or debt"

His saying, the Exalted: "without causing harm, a will from God"
4943 - My father narrated to us, Abu al-Nadr al-Dimashqi al-Faradisi narrated to us, Umar ibn al-Mughirah narrated to us, from Dawud ibn Abi Hind, from Ikrimah, from Ibn Abbas, from the Prophet, peace and blessings of God be upon him, who said: "Causing harm in the will is of the major sins."
4944 - Abu Sa'id al-Ashajj narrated to us, 'A'idh ibn Habib narrated to us, from Dawud, from Ikrimah, from Ibn Abbas, he said: "Harm in the will is of the major sins," then he recited: "without causing harm, a will from God."
4945 - Hajjaj ibn Hamzah narrated to us, Shababah narrated to us, Warqa' narrated to us, from Ibn Abi Najih, from Mujahid regarding His saying: "without causing harm": in the inheritance of his heirs.
4946 - Abu Zur'ah narrated to us, Yahya ibn Abdullah ibn Bukayr narrated to us, Abdullah ibn Lahi'ah narrated to me, Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding the saying of God the Exalted: "after any bequest you may bequeath or debt," meaning: what he owes, without there being harm caused by it, and he should not admit to a debt against him, nor bequeath more than a third [to the detriment of heirs] causing harm to them. So that is His saying: "without causing harm," meaning: without causing harm to the heirs through that distribution, "a will from God."

٤٩٤١ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنُ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ يَعْنِي: أَكْثَرَ مِنْ وَاحِدٍ، وَكَانُوا اثْنَيْنِ إِلَى عَشَرَةٍ فَصَاعِداً.
قَوْلُهُ تَعَالَى: فَهُمْ شُرَكَاءُ فِي الثُّلُثِ
٤٩٤٢ - قُرِئَ عَلَى يُونُسَ بْنِ عَبْدِ الأَعْلَى، أَنْبَأَ عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ بْنُ يَزِيدَ، عَنِ ابْنِ شِهَابٍ قَالَ: قَضَى عُمَرُ بْنُ الْخَطَّابِ أَنَّ- مِيرَاثَ الأُخْوَةِ مِنَ الأُمِّ بَيْنَهُمْ لِلذَّكَرِ فِيهِ مِثْلُ الأُنْثَى، قَالَ: وَلا أَرَى عُمَرَ بْنَ الْخَطَّابِ قَضَى بِذَلِكَ حَتَّى عَلِمَ ذَلِكَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَلِهَذِهِ الآيَةِ الَّتِي قَالَ اللَّهُ تَعَالَى: فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شركاء في الثلث، وَرُوِيَ عَنِ الْحَسَنِ، وَسَعِيدِ بْنِ جُبَيْرٍ، وَقَتَادَةَ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: مِنْ بَعْدِ وَصِيَّةً يُوصَى بِهَا أَوْ دين
قَدْ تَقَدَّمَ تَفْسِيرُهُ.
قَوْلُهُ تَعَالَى: غَيْرَ مُضَارٍّ وَصِيَّةً مِنَ اللَّهِ
٤٩٤٣ - حَدَّثَنَا أَبِي، ثنا أَبُو النَّضْرِ الدِّمَشْقِيُّ الْفَرَادِيسِيُّ، ثنا عُمَرُ بْنُ الْمُغِيرَةِ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: الإِضْرَارُ فِي الْوَصِيَّةِ مِنَ الْكَبَائِرِ.
٤٩٤٤ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا عَائِذُ بْنُ حَبِيبٍ، عَنْ دَاوُدَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ: قَالَ: الضِّرَارُ فِي الْوَصِيَّةِ مِنَ الْكَبَائِرِ، ثُمَّ قَرَأَ: غَيْرَ مُضَارٍّ وَصِيَّةً مِنَ اللَّهِ.
٤٩٤٥ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا وَرْقَاءُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ «١»
قَوْلَهُ: غَيْرَ مُضَارٍّ: فِي الْمِيرَاثِ أَهْلَهُ.
٤٩٤٦ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: مِنْ بَعْدِ وَصِيَّةً يُوصَى بِهَا أَوْ دَيْنٍ يَعْنِي، عَلَيْهِ مِنْ غَيْرِ ضِرَارٍ يَكُونُ بِهِ، وَلا يُقِرُّ بِحَقٍّ عَلَيْهِ وَلا يُوصِي بِأَكْثَرَ مِنَ الثُّلُثِ مُضَارّةً لَهُمْ، فَذَلِكَ قَوْلُهُ: غَيْرَ مُضَارٍّ يَعْنِي: غَيْرَ مُضَارٍّ لِلْوَرَثَةِ بِتِلْكَ الْقِسْمَةِ وَصِيَّةً من الله.
