and stoning. If she were to commit a clear act of immorality today, she would be taken out and stoned with stones. Then this verse abrogated it: "The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes," and the path that Allah has ordained for them is flogging and stoning.
4971 - Hajjaj ibn Hamzah narrated to us, Shababah narrated to us, Warqa' narrated to us, from Ibn Abi Najih, from Mujahid regarding His saying: "And those who commit immorality from among your women": that it is adultery.
It was narrated from al-Hasan, Ata' al-Khurasani, Sa'id ibn Jubayr, and al-Suddi that it is adultery.
His saying, the Exalted: "From among your women"
4972 - Abu Zur'ah narrated to us, Yahya ibn Abdullah ibn Bukayr narrated to us, Abdullah ibn Lahi'ah narrated to me, Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding the saying of Allah, the Exalted: "From among your women," meaning: the married woman (thayyib) among the Muslims.
His saying, the Exalted: "Then bring to witness against them four from among you"
4973 - And by the same chain from Sa'id ibn Jubayr regarding His saying: "Then bring to witness against them four from among you," meaning: from among the free Muslims.
His saying, the Exalted: "If they testify"
4974 - And by the same chain from Sa'id ibn Jubayr regarding His saying: "If they testify," meaning: to the adultery.
His saying, the Exalted: "Then detain them"
4975 - And by the same chain from Sa'id ibn Jubayr regarding His saying: "Then detain them," meaning: imprison them in prisons.
His saying, the Exalted: "In the houses"
4976 - And by the same chain from Sa'id ibn Jubayr regarding His saying: "Then detain them in the houses," meaning: in the prisons. He said: This was in the early days of Islam. When four upright Muslims testified against a woman for adultery, she would be detained in prison. If she had a husband, he would take the dower (mahr) from her, but he would provide for her without divorce. There was no prescribed legal punishment (hadd) upon her, and he would not have intercourse with her, but he would keep her detained in prison.

قَوْلَهُ: وَاللاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ: أَنَّهَا الزِّنَا

وَرُوِيَ عَنِ الْحَسَنِ، وَعَطَاءٍ الْخُرَاسَانِيِّ، وَسَعِيدِ بْنِ جُبَيْرٍ، وَالسُّدِّيِّ أَنَّهَا الزِّنَا.

قَوْلُهُ تَعَالَى: فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِنْكُمْ
٤٩٧٣ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِنْكُمْ يَعْنِي:
مِنَ الْمُسْلِمِينَ الأَحْرَارِ.
قَوْلُهُ تَعَالَى: فَإِنْ شَهِدُوا
٤٩٧٤ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ فَإِنْ شَهِدُوا يَعْنِي: الزِّنَا.
قَوْلُهُ تَعَالَى: فَأَمْسِكُوهُنَّ
٤٩٧٥ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَأَمْسِكُوهُنَّ يَعْنِي: احْبِسُوهُنَّ فِي السُّجُونِ.
قَوْلُهُ تَعَالَى: فِي الْبُيُوتِ
٤٩٧٥ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ يَعْنِي: فِي السُّجُونِ قَالَ: كَانَ هَذَا فِي أَوَّلِ الإِسْلامِ، كَانَتِ الْمَرْأَةُ إِذَا شَهِدَ عَلَيْهَا أَرْبَعَةٌ مِنَ الْمُسْلِمِينَ عُدُولٌ بِالزِّنَا- حُبِسَتْ فِي السِّجْنِ، فَإِنْ كَانَ لَهَا زَوْجٌ أَخَذَ الْمَهْرَ مِنْهَا، وَلَكِنَّهُ يُنْفِقُ عَلَيْهَا مِنْ غَيْرِ طَلاقٍ، وَلَيْسَ عَلَيْهَا حَدٌّ، وَلا يُجَامِعُهَا، وَلَكِنْ يَحْبِسُهَا فِي السِّجْنِ.
