5026 - Abu Sa'id al-Ashaj narrated to us, 'Abdah ibn Sulayman narrated to us, from al-A'mash, from Khaythamah, who said: What you read in the Quran as "O you who have believed," it is in the Torah: "O you poor ones."
5027 - My father narrated to us, Nu'aym ibn Hammad narrated to us, 'Abd Allah ibn al-Mubarak narrated to us, Mis'ar informed us, Ma'n and 'Awn—or one of them—narrated to us that a man came to 'Abd Allah ibn Mas'ud and said: Advise me. He said: When you hear Allah the Exalted saying, "O you who have believed," then lend it your ear, for it is either some good He is commanding, or some evil He is forbidding.
His saying, the Exalted: "It is not lawful for you to inherit women by compulsion."
5028 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "O you who have believed, it is not lawful for you to inherit women by compulsion," he said: When a man would die and leave a female servant, his heir would throw his garment over her and prevent her. If she were beautiful, he would marry her; and if she were ugly, he would restrain her until she died, then he would inherit her.
5029 - 'Ammar ibn Khalid narrated to us, Asbat narrated to us, from al-Shaybani, from 'Ikrimah, from Ibn 'Abbas—and Abu Ishaq mentioned it, and 'Ata' Abu al-Hasan al-Suwa'i mentioned it, and I think he only mentioned it from Ibn 'Abbas—regarding His saying: "It is not lawful for you to inherit women by compulsion," he said: When a man died, his guardians had more right to his female servants than the guardian of the woman herself. If one of them wished, he would marry her; and if they wished, they would marry her off. This verse was revealed regarding that. (It was also narrated from Abu Mijlaz something similar).
5030 - Abu Sa'id al-Ashaj narrated to us, Ibn Fudayl narrated to us, Yahya ibn Sa'id narrated to us, from Muhammad ibn Abi Umamah ibn Sahl ibn Hunayf, from his father, who said: When Abu Qays al-Aslat passed away, his son wanted to marry his wife, and that was common practice for them in the Jahiliyyah (pre-Islamic era), so Allah the Exalted revealed: "It is not lawful for you to inherit women by compulsion."
5031 - Abu Sa'id al-Ashaj narrated to us, from 'Ubayd Allah ibn Musa, from Isra'il, from al-Suddi, from Abu Malik, who said: In the Jahiliyyah, when a woman's husband died, his guardian would come and throw a garment over her. If he had a son or a brother, he would restrain her until she grew old or died, and then he would inherit her. If she escaped and went to her family before he threw the garment over her, she was saved. So Allah the Almighty revealed: "It is not lawful for you to inherit women by compulsion."
5032 - Al-Husayn ibn al-Sakan al-Basri narrated to us, Abu Zayd—meaning the grammarian—narrated to us, Qays narrated to us, from Salim, from Mujahid: "It is not lawful for you to inherit women by compulsion": This is when a man has an orphan girl under his guardianship, and he is in charge of her affairs, so he restrains her in the hope that his own wife will die so he may marry her, or his son may marry her.

٥٠٢٦ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنِ الأَعْمَشِ، عَنْ خَيْثَمَةَ قَالَ: مَا تقرأون فِي الْقُرْآنِ: يَا أَيُّهَا الَّذِينَ آمَنُوا فَإِنَّهُ فِي التَّوْرَاةِ: يَا أَيُّهَا الْمَسَاكِينُ.
٥٠٢٧ - حَدَّثَنَا أَبِي، ثنا نُعَيْمُ بْنُ حَمَّادٍ، ثنا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، أَنْبَأَ مِسْعَرٌ، ثنا مَعْنٌ وَعَوْنٌ أَوْ أَحَدُهُمَا أَنَّ رَجُلاً أَتَى عَبْدَ اللَّهِ بْنَ مَسْعُودٍ فَقَالَ: اعْهَدْ إِلَيَّ، فَقَالَ:
إِذَا سَمِعْتَ اللَّهَ تَعَالَى يَقُولُ: يَا أَيُّهَا الَّذِينَ آمَنُوا فَأَرْعِهَا سَمْعَكَ فَهُوَ خَيْرٌ يَأْمُرُ بِهِ أَوْ شَرٌّ يَنْهَى عَنْهُ.
قَوْلُهُ تَعَالَى: لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهاً
٥٠٢٨ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: يَا أَيُّهَا الَّذِينَ آمَنُوا لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كرها قَالَ: كَانَ الرَّجُلُ إِذَا مَاتَ وَتَرَكَ جَارِيَةً، أَلْقَى عَلَيْهَا حَمِيمَةَ ثَوْبِهِ، فَمَنَعَهَا، فَإِنْ كَانَتْ جَمِيلَةً تَزَوَّجَهَا، وَإِنْ كَانَتْ ذَمِيمَةً حَبَسَهَا حَتَّى تَمُوتَ فَيَرِثُهَا.
٥٠٢٩ - حَدَّثَنَا عَمَّارُ بْنُ خَالِدٍ، ثنا أَسْبَاطٌ، عَنِ الشَّيْبَانِيِّ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، وَقَالَ أَبُو إِسْحَاقَ، وَذَكَرَهُ عَطَاءٌ أَبُو الْحَسَنِ السُّوَائِيُّ، وَلا أَظُنُّهُ إِلا ذَكَرَهُ عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ: لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهاً قَالَ: كَانَ الرَّجُلُ إِذَا مَاتَ كَانَ أَوْلِيَاؤُهُ أَحَقُّ بِإِمَائِهِ مِنْ وَلِيِّ نَفْسِهَا، إِنْ شَاءَ بَعْضُهُمْ تَزَوَّجَهَا، وَإِنْ شَاءُوا زَوَّجُوهَا، فَنَزَلَتْ هَذِهِ الآيَةُ فِي ذَلِكَ- وَرُوِيَ عَنِ أَبِي مِجْلَزٍ، نَحْوُ ذَلِكَ.
٥٠٣٠ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا ابْنُ فُضَيْلٍ، ثنا يَحْيَى بْنُ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ، عَنْ أَبِيهِ قَالَ: لَمَّا تُوُفِّيَ أَبُو قَيْسٍ الأَسْلَتُ، أَرَادَ ابْنُهُ أَنْ يَتَزَوَّجَ امْرَأَتَهُ، وَكَانَ ذَلِكَ لَهُمْ فِي الْجَاهِلِيَّةِ، فَأَنْزَلَ اللَّهُ تَعَالَى: لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهاً.
٥٠٣١ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، عَنْ عُبَيْدِ اللَّهِ بْنِ مُوسَى، عَنْ إِسْرَائِيلَ، عَنِ السُّدِّيِّ، عَنْ أَبِي مَالِكٍ قَالَ: كَانَتِ الْمَرْأَةُ فِي الْجَاهِلِيَّةِ إِذَا مَاتَ زَوْجُهَا جَاءَ وَلِيُّهُ، فَأَلْقَى عَلَيْهَا ثَوْباً، فَإِنْ كان له ابن صغيرا أَوْ أَخٌ- حَبَسَهَا حَتَّى تَشِيبَ أَوْ تَمُوتَ، فَيَرِثُهَا، فَإِنْ هِيَ انْفَلَتَتْ فَأَتَتْ أَهْلَهَا وَلَمْ يُلْقِ عَلَيْهَا ثَوْباً نَجَتْ، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ: لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهاً.
٥٠٣٢ - حَدَّثَنَا الْحُسَيْنُ بْنُ السَّكَنِ الْبَصْرِيُّ، ثنا أَبُو زَيْدٍ يَعْنِي النَّحْوِيَّ، ثنا قَيْسٌ، عَنْ سَالِمٍ، عَنْ مُجَاهِدٍ «١»
لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النساء كرها: فإن الرجل يكون
