Translation · EN

His saying, the Almighty: "And if you have not entered into them, there is no sin upon you."

5092 - And by the same chain from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "There is no sin upon you," he said: "There is no blame."

5093 - Abu Sa'id al-Ashaj narrated to us, al-Muharibi narrated to us, from Sufyan ibn Dinar, who said: I asked Sa'id ibn Jubayr about a man who married a woman and she died before he had consummated the marriage with her, and she had a daughter; could he marry her daughter? He recited to me: "And your stepdaughters who are under your guardianship from your women whom you have entered into; but if you have not entered into them, there is no sin upon you." He said: "There is no sin upon him to marry her."

His saying, the Almighty: "And the wives of your sons who are from your loins."

5094 - Ja'far ibn Muhammad ibn Harun ibn 'Azrah narrated to us, 'Abd al-Wahhab narrated to us, he said: Sa'id said: Qatadah used to dislike that if a man married a woman, then divorced her before he had consummated the marriage with her, his father should marry her, and he would interpret [this through] the verse: "And the wives of your sons who are from your loins."

5095 - Abu Zur'ah narrated to us, Muhammad ibn Abi Bakr al-Maqdisi narrated to us, Khalid ibn al-Harith narrated to us, from Ash'ath, from al-Hasan and Muhammad: That these verses are general [mubhamat], including: "And the wives of your sons," and "And the mothers of your women." It was narrated from Tawus, Muhammad ibn Sirin, Ibrahim, al-Zuhri, and Makhul something similar.

His saying, the Almighty: "Who are from your loins."

5096 - Sulayman ibn Dawud, the freed slave of Ja'far ibn Abi Talib, narrated to us, Sahl ibn 'Uthman narrated to us, Yahya—meaning ibn Abi Za'idah—narrated to us, Dawud ibn 'Abd al-Rahman narrated to us, from Ibn Jurayj, who said: I asked 'Ata' about: "And the wives of your sons." He said: "We used to discuss, and Allah knows best, that when the Prophet (peace be upon him) married the wife of Zayd, the polytheists in Mecca spoke about that, so Allah the Almighty revealed: 'And the wives of your sons who are from your loins.'"

His saying, the Almighty: "And that you combine two sisters [in marriage]."

5097 - I read to Muhammad ibn 'Abd Allah ibn 'Abd al-Hakam, Ibn Wahb informed us, Malik informed me, from Ibn Shihab, from Qabisah ibn Dhu'ayb, that a man asked 'Uthman ibn 'Affan about two sisters from among those owned by the right hand [slaves], can one combine them [in concubinage]? 'Uthman said: "A verse made them lawful, and a verse made them unlawful, and I would not do that." He left him and met a man from the companions of the Prophet (peace be upon him) and asked him about that. He said: "If I had any authority in the matter and I found anyone doing that, I would have meted out a punishment upon him." Malik said: Ibn Shihab said: "I think it was 'Ali ibn Abi Talib." He said: "And it reached me from al-Zubayr ibn al-'Awwam something similar."

قَوْلُهُ تَعَالَى: فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلا جُنَاحَ عَلَيْكُمْ

٥٠٩٢ - وَبِهِ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ فَلا جُنَاحَ عَلَيْكُمْ قَالَ: فَلا حَرَجَ.

٥٠٩٣ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا الْمُحَارِبِيُّ، عَنْ سُفْيَانَ بْنِ دِينَارٍ قَالَ: سَأَلْتُ سَعِيدَ بْنَ جُبَيْرٍ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَتْ قَبْلَ أَنْ يَدْخُلَ بِهَا، وَلَهَا بِنْتٌ أَيَتَزَوَّجُ بَنَتْهَا؟ فَتَلا عَلَيَّ: وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلا جُنَاحَ عَلَيْكُمْ قَالَ: لَا جُنَاحَ عَلَيْهِ أَنْ يَتَزَوَّجَهَا.

قَوْلُهُ تَعَالَى: وَحَلائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلابِكُمْ

٥٠٩٤ - حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ هَارُونَ بْنِ عَزْرَةَ، ثنا عَبْدُ الْوَهَّابِ قَالَ سَعِيدٌ:

وَكَانَ قَتَادَةُ يَكْرَهُ إِذَا تَزَوَّجَ الرَّجُلُ الْمَرْأَةَ، ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا أَنْ يَتَزَوَّجَهَا أَبُوهُ، وَيَتَأَوَّلُ: وَحَلائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلابِكُمْ.

٥٠٩٥ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا مُحَمَّدُ بْنُ أَبِي بكر المقدسي، ثنا خَالِدُ بْنُ الْحَارِثِ، عَنْ أَشْعَثَ، عَنِ الْحَسَنِ وَمُحَمَّدٍ: أَنَّ هَؤُلاءِ الآيَاتِ مُبْهَمَاتٌ وَحَلائِلُ أَبْنَائِكُمْ، وَأُمَّهَاتُ نِسَائِكُمْ وَرُوِيَ عَنِ طَاوُسٍ وَمُحَمَّدِ بْنِ سِيرِينَ وَإِبْرَاهِيمَ وَالزُّهْرِيِّ وَمَكْحُولٍ نَحْوُ ذَلِكَ.

قَوْلُهُ تَعَالَى: الَّذِينَ مِنْ أَصْلابِكُمْ

٥٠٩٦ - حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ مَوْلَى جَعْفَرِ بْنِ أَبِي طَالِبٍ، ثنا سَهْلُ بْنُ عُثْمَانَ، ثنا يَحْيَى يَعْنِي: ابْنَ أَبِي زَائِدَةَ، ثنا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: سَأَلْتُ عَطَاءً عَنْ: وَحَلائِلُ أَبْنَائِكُمْ قَالَ: كُنَّا (نَتَحَدَّثُ) «١» وَاللَّهُ أَعْلَمُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا نَكَحَ امْرَأَةَ زَيْدٍ، فَقَالَ الْمُشْرِكُونَ بِمَكَّةَ فِي ذَلِكَ، فَأَنْزَلَ اللَّهُ تَعَالَى:

وَحَلائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلابِكُمْ

قَوْلُهُ تَعَالَى: وَأَنْ تَجْمَعُوا بَيْنَ الأُخْتَيْنِ

٥٠٩٧ - قَرَأْتُ عَلَى مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ، أَنْبَأَ ابْنُ وَهْبٍ، أَخْبَرَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّ رَجُلا سَأَلَ عُثْمَانَ بْنَ عَفَّانَ عَنِ الأُخْتَيْنِ مِنْ مِلْكِ الْيَمِينِ، هَلْ يُجْمَعُ بَيْنَهُمَا؟ فَقَالَ عُثْمَانُ: أَحَلَّتْهُمَا آيَةٌ، وَحَرَّمَتْهُمَا
