The second interpretation:
5129 - My father narrated to us, Hudbah narrated to us, Sulayman ibn al-Mughirah narrated to us, who said: Al-Hasan was asked while I was listening: What is al-musafihah (illicit sexual intercourse)? He said: It is that a man does not commit adultery with her specifically, rather she follows anyone who seeks her.
His saying, the Almighty: "So for whatever you enjoy [of marriage] from them"
5130 - Abu Sa'id al-Ashajj narrated to us, Ishaq ibn Sulayman narrated to us, from Musa ibn 'Ubaydah, who said: I heard Muhammad ibn Ka'b al-Qurazi, from Ibn 'Abbas, who said: The mut'ah (temporary marriage) of women existed in the early days of Islam. A man would arrive in a town, having no one with him to manage his affairs or look after his property, so he would marry a woman for the duration he estimated it would take to finish his business, and she would look after his property and manage his affairs. He used to say: The verse "So for whatever you enjoy [of marriage] from them" was abrogated by "desiring chastity, not illicit sexual intercourse," and the authority for marriage was in the man's hand; he would keep her as long as he wished and divorce her whenever he wished.
5131 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "So for whatever you enjoy [of marriage] from them," he said: And the enjoyment (istimta') is marriage. Similar to this has been narrated from al-Hasan(1), Mujahid, and al-Zuhri.
5132 - My father narrated to us, Ibn Abi 'Umar narrated to us, who said: Sufyan said regarding His saying: "So for whatever you enjoy [of marriage] from them, give them their required due as an obligation," he said: This is regarding the mut'ah (temporary marriage); they had been commanded to do it before they were forbidden from it.

[The first interpretation]
5133 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "give them their required due as an obligation," he said: If a man among you marries a woman, then has intercourse with her once, her entire dowry becomes due.
5134 - Abu Zur'ah mentioned it, Muhammad ibn Abi Bakr al-Muqaddami narrated to us, 'Amir ibn Salih narrated to us, from Yunus, from al-Hasan regarding: "So for whatever you enjoy [of marriage] from them, give them their required due as an obligation," he said: It means marriage and the dowry.
The second interpretation:
5135 - Muhammad ibn Isma'il al-Ahmasi narrated to us, Waki' narrated to us, from Sufyan, from Dawud ibn Abi Hind, from Sa'id ibn al-Musayyib, who said: The verse of inheritance abrogated the [verse of] mut'ah.

٥١٢٩ - حَدَّثَنَا أَبِي، ثنا هُدْبَةُ، ثنا سُلَيْمَانُ بْنُ الْمُغِيرَةِ قَالَ: سُئِلَ الْحَسَنُ وَأَنَا أَسْمَعُ، مَا الْمُسَافِحَةُ؟ قَالَ: هِيَ الَّتِي لَا يَزْنِي إِلَيْهَا رَجُلٌ بِعَيْنِهِ إِلا تَبِعَتْهُ.
قَوْلُهُ تَعَالَى: فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ
٥١٣٠ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا إِسْحَاقَ بْنَ سُلَيْمَانَ، عَنْ مُوسَى بْنِ عُبَيْدَةَ قَالَ: سَمِعْتُ مُحَمَّدَ بْنَ كَعْبٍ الْقُرَظِيَّ، عَنِ ابْنِ عَبَّاسٍ قَالَ: كَانَتْ مُتْعَةُ النِّسَاءِ فِي أَوَّلِ الإِسْلامِ، كَانَ الرَّجُلُ يَقْدُمُ الْبَلْدَةَ، لَيْسَ مَعَهُ مَنْ يُصْلِحُ لَهُ ضَيْعَتَهُ وَلا يُصْلِحُ بِحِفْظِ مَتَاعِهِ، فَيَتَزَوَّجُ الْمَرْأَةَ إِلَى قَدْرِ مَا يَرَى أَنَّهُ يَفْرُغُ مِنْ حَاجَتِهِ، فَتَنْظُرُ لَهُ مَتَاعَهُ وَتُصْلِحُ لَهُ ضَيْعَتَهُ، وَكَانَ يَقُولُ: فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ نَسَخَتْهَا مُحْصِنِينَ غَيْرَ مُسَافِحِينَ وَكَانَ الإِحْصَانُ بِيَدِ الرَّجُلِ، يُمْسِكُ مَتَى شَاءَ وَيُطَلِّقُ مَتَى شَاءَ.
٥١٣١ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عن ابن عباس قوله: فما اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ قَالَ: وَالاسْتِمْتَاعُ: هُوَ النِّكَاحُ- وَرُوِيَ عَنِ الْحَسَنِ «١» وَمُجَاهِدٍ وَالزُّهْرِيِّ نَحْوُ ذَلِكَ.
٥١٣٢ - حَدَّثَنَا أَبِي، ثنا ابْنُ أَبِي عُمَرَ قَالَ: قَالَ سُفْيَانُ فِي قَوْلِهِ: فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ فَآتُوهُنَّ أُجُورَهُنَّ قَالَ: هَذَا فِي الْمُتْعَةِ كَانُوا قَدْ أُمِرُوا بِهَا قَبْلَ أَنْ يُنْهَوْا عَنْهَا.
قَوْلُهُ تَعَالَى: فآتوهن أجورهن فريضة

٥١٣٣ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: فَآتُوهُنَّ أُجُورَهُنَّ فَرِيضَةً قَالَ: إِذَا تَزَوَّجَ الرَّجُلُ مِنْكُمُ الْمَرْأَةَ، ثُمَّ نَكَحَهَا مَرَّةً وَاحِدَةً، فَقَدْ وَجَبَ صَدَاقُهَا كُلُّهُ.
٥١٣٤ - ذَكَرَهُ أَبُو زُرْعَةَ، ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ، ثنا عَامِرُ بْنُ صَالِحٍ، عَنْ يُونُسَ، عَنِ الْحَسَنِ فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ فَآتُوهُنَّ أُجُورَهُنَّ قَالَ: التَّزَوُّجُ وَالْمَهْرُ.

٥١٣٥ - حَدَّثَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الأَحْمَسِيُّ، ثنا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ قَالَ: نَسْخَ آيَةَ الْمِيرَاثِ الْمُتْعَةُ.
