5136 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "And there is no blame upon you regarding that which you have mutually agreed upon from after the fixed due [dowry]," and the mutual agreement is that he fulfills her dowry, then he gives her the choice.
The second interpretation:
5137 - I read to Muhammad ibn 'Abd Allah ibn 'Abd al-Hakam, Ibn Wahb reported, Yunus said, and Rabi'ah said: Allah the Almighty says "And there is no blame upon you regarding that which you have mutually agreed upon," if she gives her husband something after the fixed due [dowry] or does a favor for him, then that is what He said.
His saying, the Almighty: "from after the fixed due [dowry]"
5138 - I read to Muhammad ibn al-Fadl, Muhammad ibn 'Ali narrated to us, Muhammad ibn Muzahim reported, from Bukayr, from Muqatil ibn Hayyan regarding His saying: "from after the fixed due [dowry]," he means: what is after the initial specification.

5139 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "And whoever among you cannot afford," he says: whoever does not have the capacity.
It was narrated from Mujahid, Sa'id ibn Jubayr, Abu Malik, al-Suddi, and 'Ata' al-Khurasani that they said: The "tawl" (capacity) is wealth.
5140 - 'Ali ibn al-Husayn narrated to us, Abu al-Tahir narrated to us, Ibn Wahb narrated to us, 'Abd al-Jabbar informed me, from Rabi'ah, that he said regarding the saying of Allah the Almighty: "And whoever among you cannot afford," Rabi'ah said: The "tawl" is desire, he said: He marries the slave girl when his desire is for her.

5141 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding his saying: "to marry the free, believing women," he says: to marry the free women. Similar to this was narrated from 'Atiyyah, Mujahid, Muqatil ibn Hayyan, and Qatadah.

٥١٣٦ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَلا جُنَاحَ عَلَيْكُمْ فِيمَا تَرَاضَيْتُمْ بِهِ مِنْ بَعْدِ الْفَرِيضَةِ وَالتَّرَاضِي: أَنْ يُوفِيَهَا صَدَاقَهَا ثُمَّ يُخَيِّرُهَا.
وَالْوَجْهُ الثَّانِي:
٥١٣٧ - قَرَأْتُ عَلَى مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ، أَنْبَأَ ابْنُ وَهْبٍ، قَالَ يُونُسُ: وَقَالَ رَبِيعَةُ: يَقُولُ اللَّهُ تَعَالَى وَلا جُنَاحَ عَلَيْكُمْ فِيمَا تَرَاضَيْتُمْ بِهِ إِنْ أَعْطَتْ زَوْجَهَا مِنْ بَعْدِ الْفَرِيضَةِ أَوْ صَنَعَتْ إِلَيْهِ، فَذَلِكَ الَّذِي قَالَ.
قَوْلُهُ تَعَالَى: مِنْ بَعْدِ الْفَرِيضَةِ
٥١٣٨ - قَرَأْتُ عَلَى مُحَمَّدِ بْنِ الْفَضْلِ، ثنا مُحَمَّدُ بْنُ عَلِيٍّ، أَنْبَأَ مُحَمَّدُ بْنُ مُزَاحِمٍ، عَنْ بُكَيْرٍ، عَنْ مُقَاتِلِ بْنِ حَيَّانَ قَوْلُهُ: مِنْ بَعْدِ الْفَرِيضَةِ يَعْنِي: مَا بَعْدَ تَسْمِيَةِ الأَوَّلِ.
قَوْلُهُ تَعَالَى: إِنَّ اللَّهَ كَانَ عَلِيماً حَكِيماً
قَدْ تَقَدَّمَ تَفْسِيرُهُ.
قَوْلُهُ تَعَالَى: وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلا
٥١٣٩ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، قَوْلَهُ: وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلا يَقُولُ: مَنْ لَمْ يَكُنْ لَهُ سَعَةٌ

وَرُوِيَ عَنِ مُجَاهِدٍ وَسَعِيدِ بْنِ جُبَيْرٍ، وَأَبِي مَالِكٍ وَالسُّدِّيِّ وَعَطَاءٍ الْخُرَاسَانِيِّ قَالُوا: الطَّوْلُ: الْغِنَى.
٥١٤٠ - حَدَّثَنَا عَلِيُّ بْنُ الْحُسَيْنِ، ثنا أَبُو الطَّاهِرِ، ثنا ابْنُ وَهْبٍ، أَخْبَرَنِي عَبْدُ الْجَبَّارِ، عَنْ رَبِيعَةَ، أَنَّهُ قَالَ فِي قَوْلِ اللَّهِ تَعَالَى وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلا قَالَ رَبِيعَةُ: الطَّوْلُ: الْهَوَى، قَالَ: يَنْكِحُ الأَمَةَ إِذَا كَانَ هَوَاهُ فِيهَا.
قَوْلُهُ تَعَالَى: أَنْ يَنْكِحَ المحصنات المؤمنات

٥١٤١ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، قَوْلَهُ: أَنْ يَنْكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ يَقُولُ: أَنْ يَنْكِحَ الْحَرَائِرَ- وَرُوِيَ عَنِ عَطِيَّةَ وَمُجَاهِدٍ وَمُقَاتِلِ بْنِ حَيَّانَ وَقَتَادَةَ نَحْوُ ذَلِكَ.
