His saying, the Almighty: "an act of obscenity"
5160 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "If they commit an act of obscenity," meaning: if she marries a free man and then commits adultery. Similar to this was narrated from al-Sha'bi, Sa'id ibn Jubayr, Mujahid, al-Hasan, and Qatadah.
His saying, the Almighty: "upon them"
5161 - Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to us, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding His saying: "upon them," he said: upon the bondswoman. Similar to this was narrated from al-Suddi.
His saying, the Almighty: "half of what is upon the chaste women"
5162 - Abu Zur'ah narrated to us, with his chain of narration from Sa'id ibn Jubayr regarding His saying: "half of what is upon the chaste women," he said: upon the bondswoman is half of what is upon the free woman in terms of lashing, which is fifty lashes. Similar to this was narrated from al-Suddi and Muqatil ibn Hayyan.
His saying, the Almighty: "of the punishment"
5163 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "upon them is half of what is upon the chaste women of the punishment," he said: of the lashing. Similar to this was narrated from Sa'id ibn Jubayr.
His saying, the Almighty: "That is for whoever among you fears hardship"
5164 - And with the same chain from Ibn 'Abbas regarding His saying: "That is for whoever among you fears hardship," he said: "Hardship" is adultery, which is immorality. Thus, it is not permissible for any free man to marry a bondswoman unless he is unable to afford a free woman and he fears hardship. Similar to this was narrated from Mujahid, al-Hasan, Sa'id ibn Jubayr, 'Atiyyah, al-Suddi, al-Dahhak, Qatadah, 'Amr ibn Dinar, and Muqatil ibn Hayyan.
His saying, the Almighty: "And that you act patiently"
5165 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "And that you act patiently is better for you," he said: And that you act patiently regarding not marrying the bondswoman is better for you. Similar to this was narrated from Mujahid, Tawus, al-Hasan, Sa'id ibn Jubayr, al-Suddi, Jabir ibn Zayd, 'Atiyyah, Qatadah, and Muqatil ibn Hayyan.
قَوْلُهُ تَعَالَى: بِفَاحِشَةٍ
٥١٦٠ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: فَإِنْ أَتَيْنَ بِفَاحِشَةٍ يَعْنِي: إِذَا تَزَوَّجَتْ حُرّاً ثُمَّ زَنَتْ- وَرُوِيَ عَنِ الشَّعْبِيِّ، وَسَعِيدِ بْنِ جُبَيْرٍ وَمُجَاهِدٍ وَالْحَسَنِ وَقَتَادَةَ نحو ذلك
قَوْلُهُ تَعَالَى: فَعَلَيْهِنَّ
٥١٦١ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، ثنا ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَعَلَيْهِنَّ قَالَ: فَعَلَى الْوِلايَةِ- وَرُوِيَ عَنِ السُّدِّيِّ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: نِصْفُ مَا عَلَى الْمُحْصَنَاتِ
٥١٦٢ - حَدَّثَنَا أَبُو زُرْعَةَ، بِإِسْنَادِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: نِصْفُ مَا عَلَى الْمُحْصَنَاتِ قَالَ: فَعَلَى الْوَلايَةِ نِصْفُ مَا عَلَى الْحُرَّةِ مِنَ الْجَلْدِ وَهِيَ خَمْسُونَ جَلْدَةً- وَرُوِيَ عَنِ السُّدِّيِّ وَمُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: مِنَ الْعَذَابِ
٥١٦٣ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ قَالَ: مِنَ الْجَلْدِ- وَرُوِيَ عَنِ سَعِيدِ بْنِ جُبَيْرٍ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: ذَلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنْكُمْ
٥١٦٤ - وَبِهِ عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: ذَلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنْكُمْ قَالَ: الْعَنَتُ:
الزِّنَا وَهُوَ الْفُجُورُ، فَلَيْسَ لأَحَدٍ مِنَ الأَحْرَارِ أَنْ يَنْكِحَ أَمَةً إِلا أَلا يَقْدِرَ عَلَى حُرَّةٍ وَهُوَ يَخْشَى الْعَنَتَ- وَرُوِيَ عَنْ مُجَاهِدٍ وَالْحَسَنِ وَسَعِيدِ بْنِ جُبَيْرٍ وَعَطِيَّةَ وَالسُّدِّيِّ وَالضَّحَّاكِ، وَقَتَادَةَ وَعَمْرِو بْنِ دِينَارٍ وَمُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: وَأَنْ تَصْبِرُوا
٥١٦٥ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَأَنْ تَصْبِرُوا خَيْرٌ لَكُمْ قَالَ: وَأَنْ تَصْبِرُوا عَنْ نِكَاحِ
