His saying the Exalted: "And to every one We have appointed heirs."
5233 - Abu Sa'id al-Ashajj narrated to us, Abu Usamah narrated to us, he said: Idris al-Awdi said: Talhah ibn Musarrif informed me, from Sa'id ibn Jubayr, from Ibn 'Abbas regarding His saying: "And to every one We have appointed heirs," he said: Heirs (warathah).
5234 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas regarding His saying: "And to every one We have appointed heirs of what has been left by the parents and the relatives," he said: The "heirs" (al-mawali) are the paternal relatives (al-'asabah), meaning the inheritors. It has been narrated from Mujahid, Sa'id ibn Jubayr, Abu Salih, Qatadah, Zayd ibn Aslam, al-Suddi, al-Dahhak, and Muqatil ibn Hayyan the likes of that.
His saying the Exalted: "Of what has been left by the parents and the relatives."
5235 - Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding His saying: "Of what has been left by the parents and the relatives," meaning: From the inheritance.
His saying the Exalted: "And to those your oaths have made a pact."

5236 - Abu Sa'id al-Ashajj narrated to us, Abu Usamah narrated to us, he said: Idris al-Awdi said: Talhah ibn Musarrif informed me, from Sa'id ibn Jubayr, from Ibn 'Abbas regarding His saying: "And to those your oaths have made a pact, so give them their share," he said: When the Emigrants (Muhajirun) arrived in Medina, an Ansar man would inherit over his blood relatives through the brotherhood which the Messenger of Allah (peace be upon him) established between them. When this verse was revealed: "And to every one We have appointed heirs," it was abrogated. Then He said: "And to those your oaths have made a pact, so give them their share."
5237 - Al-Hasan ibn Muhammad ibn al-Sabbah narrated to us, Hajjaj narrated to us, from Ibn Jurayj and 'Uthman ibn 'Ata', from 'Ata', from Ibn 'Abbas, who said: "And to those your oaths have made a pact, so give them their share." In the Pre-Islamic era (Jahiliyyah), a man would make a pact with another saying: You shall inherit from me and I shall inherit from you. Friends used to enter into alliances. The Messenger of Allah (peace be upon him) said: "Any alliance or pact that existed in the Jahiliyyah, Islam only increases it in intensity; and there is no pact or alliance in Islam [that allows inheritance]." Thus, this verse abrogated it.

٥٢٣٣ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو أُسَامَةَ قَالَ إِدْرِيسُ الأَوْدِيُّ: أَخْبَرَنِي طَلْحَةُ بْنُ مُصَرِّفٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ وَلِكُلٍّ جَعَلْنَا مَوَالِيَ قَالَ: وَرَثَةً.
٥٢٣٤ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، قَوْلَهُ: وَلِكُلٍّ جَعَلْنَا مَوَالِيَ مِمَّا تَرَكَ الْوَالِدَانِ وَالأَقْرَبُونَ قَالَ: الْمَوَالِي: الْعَصَبَةُ يَعْنِي الْوَرَثَةَ- وَرُوِيَ عَنِ مُجَاهِدٍ وَسَعِيدِ بْنِ جُبَيْرٍ وَأَبِي صَالِحٍ، وَقَتَادَةَ وَزَيْدِ بْنِ أَسْلَمَ وَالسُّدِّيِّ وَالضَّحَّاكِ، وَمُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: مِمَّا تَرَكَ الْوَالِدَانِ وَالأَقْرَبُونَ
٥٢٣٥ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: مِمَّا تَرَكَ الْوَالِدَانِ وَالأَقْرَبُونَ يَعْنِي:
مِنَ الْمِيرَاثِ.

٥٢٣٦ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو أُسَامَةَ قَالَ إِدْرِيسُ الأَوْدِيُّ، أَخْبَرَنِي طَلْحَةُ بْنُ مُصَرِّفٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ: وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ قَالَ: كَانَ الْمُهَاجِرُونَ حِينَ قَدِمُوا الْمَدِينَةَ يُورَثُ الأَنْصَارِيُّ دُونَ ذَوِي رَحِمِهِ بِالأُخُوَّةِ الَّتِي آخَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَهُمْ، فَلَمَّا نَزَلَتْ هَذِهِ الآيَةُ: وَلِكُلٍّ جَعَلْنَا مَوَالِي نُسِخَتْ ثُمَّ قَالَ: وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ.
٥٢٣٧ - حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ الصَّبَّاحِ، ثنا حَجَّاجٌ، عَنِ ابْنِ جُرَيْجٍ، وَعُثْمَانَ بْنِ عَطَاءٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ قَالَ: وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ وَكَانَ الرَّجُلُ قَبْلَ الإِسْلامِ يُعَاقِدُ الرَّجُلَ يَقُولُ: تَرِثُنِي وَأَرِثُكَ، وَكَانَ الأَحِبَّاءُ يَتَحَالَفُونَ، فَقَال رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: كُلُّ حِلْفٍ كَانَ فِي الْجَاهِلِيَّةِ أَوْ عَقْدٍ أَدْرَكَهُ الإِسْلامُ، فَلا يَزِيدُهُ الإِسْلامُ إِلا شِدَّةً، وَلا عَقْدَ وَلا حِلْفَ عَنِ الْإِسْلَامِ، فَنَسَخَتْهَا هَذِهِ
